RESOLUTION NO. 110330

 

Suspending City Council Standing Rule 34, “To amend rules,” to allow adoption of new Council Committees prior to May 1, 2011, and amending City Council Standing Rule 6, “Committees, appointment of,” and Rule 35, “Annual review of appointed positions,” to reflect the establishment of Council committees for the term of office beginning May 1, 2011.

 

WHEREAS, City Council Standing Rule 34 provides that any change to the City Council Standing Rules shall be referred to the Finance and Audit Committee, thus preventing amendments to the Rules from being introduced and adopted at the same meeting of the City Council; and

 

WHEREAS, City Council Standing Rule 33 authorizes the suspension of any City Council Standing Rule by a vote of seven members of the Council, including the Mayor; and

 

WHEREAS, to reflect the announced organization of the City Council into standing committees for the term of office beginning May 1, 2011, the new standing committees should be established now; and

 

WHEREAS, these amendments reflect no change in procedures, but only changes in the names and responsibilities of standing committees; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Suspension of Rule 34. That City Council Standing Rule 34 is suspended for consideration of this Resolution.

 

Section 2. Amendment of Rule 6. That City Council Standing Rule 6 is amended to reflect the establishment of Council committees for the term of office beginning May 1, 2011 to read as follows:

Rule 6. Committees, appointment of.

 

As soon as practicable after an election but no later than the first day of a council term, the mayor as president of the council shall appoint three to five Council members to serve on each of the following standing Council committees:

 

(1)               Finance, Governance & Ethics Committee

 

(2)               Transportation & Infrastructure Committee

 

(3)               Plans, Zoning & Economic Development Committee

 

(4)               Public Safety & Emergency Services Committee

 

(5) Neighborhoods & Healthy Communities Committee

 

When making these appointments, the Mayor shall designate who shall serve as chairperson and vice chairperson of each standing committee. The Mayor may serve as an appointed member to one or more of the standing committees. The membership of each of these standing committees shall not exceed five Council members.

 

During a Councilmanic term, the Mayor may change the appointments to these standing committees and the designations of chairperson and vice chairperson of those standing committees.

 

In addition to the standing committees, the mayor may appoint special committees, not encompassed by the foregoing committees. A simple majority of the membership of a special committee shall constitute a quorum.

 

No new Council member shall serve on any Council committee who has not received orientation training on ethics as required by Section 2-1012.5, Code of Ordinances

 

Section 3. Amendment of Rule 35. That City Council Standing Rule 35 is amended to reflect the establishment of Council committees for the term of office beginning May 1, 2011 to read as follows:

 

Rule 35. Annual review of appointed positions.

 

The City Manager, City Auditor and City Clerk shall be reviewed annually as follows:

 

(1)               The Finance, Governance & Ethics Committee shall review the performance and salary of the City Auditor and make recommendations to the entire council.

 

(2)               The Finance, Governance & Ethics Committee shall review the performance and salary of the City Clerk and make recommendations to the entire Council.

 

(3)               The Council shall review the performance and salary of the City Manager.

 

(4)               The purpose of this rule is to insure that the performance and salary of the above three positions are reviewed at least annually and no provision of this rule shall prevent a designated committee or the Council from performing such a review of the positions assigned to it at any other time.
