RESOLUTION NO. 051467
Amending the Downtown Industrial
Area Plan for the general area located west of Broadway, south of Truman Road,
north of Southwest Boulevard and east of I-35, and in addition, the area
between Broadway Boulevard on the west and Baltimore Avenue on the east and
from 17th Terrace on the north to 18th Street on the south, by changing the
recommended land use from light industry to mixed uses
(residential/commercial/light industrial). (211-S-12)
WHEREAS, on June
15, 1978, the City Council by Resolution No. 49188 adopted the Downtown
Industrial Area Plan as the Plan for development and redevelopment of that area
bounded by I-35 on the north, the Terminal Railroad tracks on the south, Troost
Avenue on the east and Southwest Trafficway on the west; and
WHEREAS, said
Downtown Industrial Area Plan was amended on June 25, 1998, through the
adoption of Resolution No. 980549; was amended on January 13, 2000, through the
adoption of Resolution No. 991627; was further amended on August 29, 2002,
through the adoption of Resolution No. 020942; was further amended on February
20, 2003, through the adoption of Resolution No. 030117; was further amended on
July 1, 2004, through the adoption of Resolution No. 040576, was further
amended on April 28, 2005, through the adoption of Resolution No. 050413; and
WHEREAS, after
further review by the City Development Department, it has been deemed
appropriate to further amend the Downtown Industrial Area Plan as it affects
that general area located west of Broadway, south of Truman Road, north of
Southwest Boulevard and east of I-35, and in addition, the area between
Broadway Boulevard on the west and Baltimore Avenue on the east and from 17th
Terrace on the north to 18th Street on the south, by changing the recommended
land use from light industry to mixed uses (residential/commercial/light
industrial); and
WHEREAS, public
notice of a hearing was published for the City Plan Commission Hearing on
November 21, 2005; and
WHEREAS, the
City Plan Commission considered such amendment to the Proposed Land Use Plan
and Map on December 6, 2005; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on December 6, 2005, make its recommendation on the
proposed amendment to the Downtown Industrial Area Plan; NOW, THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the Downtown Industrial Area Plan is hereby amended as to the Proposed Land Use
Plan and Map for that general area located west of Broadway, south of Truman
Road, north of Southwest Boulevard and east of I-35, and in addition, the area
between Broadway Boulevard on the west and Baltimore Avenue on the east and
from 17th Terrace on the north to 18th Street on the south, by changing the
recommended land use from light industry to mixed uses
(residential/commercial/light industrial). A copy of the amendment to the
Proposed Land Use Plan and Map of the Downtown Industrial Area Plan is attached
hereto as Exhibit A and incorporated herein by reference.
Section B. That
the amendment to the Downtown Industrial Area Plan is consistent and complies
with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee
Substitute 030117 for Resolution No. 971268, and is adopted as a supplement to
the FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by law have
been given and had.
