COMMITTEE SUBSTITUTE ORDINANCE NO. 961288

 

Amending Chapter 64 of the Code of Ordinances, entitled Streets, Sidewalks And Public Places, by repealing therein Section 64-203, Same - Time for completion, and amending Chapter 2 of the Code of Ordinances, entitled Administration, by enacting a new Section 2-1654, Time for Completion.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 64 of the Code of Ordinances, entitled Streets, Sidewalks And Public Places, is hereby amended by repealing therein Section 64-203, Same - Time for completion.

 

Section B. That Chapter 2 of the Code of Ordinances, entitled Administration, is hereby amended by enacting a new Section 2-1654, Time for completion, which section reads as follows:

 

Sec. 2-1654 Time for completion.

 

All contracts for the construction of improvements, entered into by any city department or board, shall specify the time in which the contract shall be completed. The department or board administering the contract shall have the discretion to determine whether liquidated damages shall be provided in a contract, and if so, shall prescribe an amount which shall be deducted from the amount of the contract price due the contractor for failure on the part of such contractor to complete the contract within the time specified. Should any contingency arise in the prosecution of the work or contract resulting from delay caused or ordered by the city or by circumstances beyond the control of the contractor, an extension of the time of completion of such contract may be granted by the city department or board administering the contract, which shall be endorsed upon such contract, stating the reason therefor, and the city department or board may remit the liquidated damages claimed for the time so extended; provided, however, that where payment for the work specified in the contract is to be made by special tax bills, any extension of time for the completion of such contract shall be made only by authority of an ordinance of the council, and such extension so authorized, together with the number and date of the approval of the ordinance or authorizing the extension, shall be endorsed on such contract.
