ORDINANCE NO. 040893

 

Authorizing the Director of Environmental Management to enter into an amendment with Deffenbaugh Recycling Services, Inc., of the recycling contract approved by Ordinance No. 040087 by increasing the maximum authorized first-year expenditure by $63,756.00 for a maximum total of $1,737,671.00 from funds previously appropriated.

 

WHEREAS, Deffenbaugh Recycling, Inc. is authorized to charge $1.56 per household for recycling services commencing December 1, 2004, when it fully implements its MBE subcontracting; and

 

WHEREAS, the City and Deffenbaugh Recycling, Inc. agree that the implementation of MBE participation in the RecycleFIRST can begin September 1, 2004; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Environmental Management is authorized to execute, on behalf of the City, an amendment to the contract with Deffenbaugh Recycling, Inc., for curbside collection, processing and marketing of recyclables approved by Ordinance No. 040087 by authorizing a per-household rate of $1.56 commencing September 1, 2004, and expending an additional amount not to exceed $63,756.00 for a total first year amount of not more than $1,737,671.00 from funds previously appropriated. A copy of the amendment is on file in the office of the Director of Environmental Management and is incorporated by reference.

 

Section 2. That the Director of Environmental Management is authorized to expend a sum not to exceed $1,737,671.00 contingent upon funds being appropriated in Account No. 05-1000-852225-B for the period May 1, 2004 through April 30, 2005.
