ORDINANCE NO. 970910

 

Approving the plat of Oaks of North Brook Second Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; and accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Oaks of North Brook Second Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

 

Section 4. That all right, title and interest in a standard sewer easement recorded Document No. N3202, Book 2572, page 591 and a storm drainage easement recorded under Document No. E3235, Book 1446, page 455, be and the same are hereby released to the respective owner, their successors or assigns, over that part of aforesaid easements.

 

Section 5. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 23937 duly adopted on June 17, 1997, for public use for park purposes to-wit:

 

A tract of land in the Southwest Quarter and the Southeast Quarter of Section 15, Township 51, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the northeast corner of said Southwest Quarter; thence North 88 57'08" West, along the north line of said Southwest Quarter, 357.25 feet; thence South 01 02'52" West, 40.00 feet to a point on the southerly right of way line of N.E. 76th Street, as now established, said point being also the true point of beginning of the tract to be herein described; thence continuing South 01 02'52" West, 299.57 feet; thence South 36 01'29" East, 168.55 feet; thence South 41 32'03" East, 144.24 feet; thence North 48 27'57" East, 120.00 feet; thence South 41 32'03" East, 50.00 feet; thence South 48 27'57" West, 120.00 feet; thence South 41 32'03" East, 282.63 feet; thence South 43 19'56" East, 88.22 feet; thence South 64 55'01" East, 176.43 feet; thence South 86 37'44" East, 88.22 feet to a point on the westerly line of Oaks of North Brook - First Plat, a subdivision of land in Kansas City, Clay County, Missouri; thence South 3 22'18" West, along said westerly line, 140.35 feet; thence South 15 50'53" East, along said westerly line, 195.34 feet to the most southerly corner of said Oaks of North Brook - First Plat; thence South 01 56'54" East, 122.77 feet; thence westerly along a curve to the right, having an initial tangent bearing of South 88 03'06" West, a radius of 1300.00 feet, an arc distance of 669.14 feet; thence North 27 32'36" East, 120.00 feet; thence North 09 50'25" East, 189.25 feet; thence North 21 38'21" West, 109.37 feet; thence North 35 18'41" West, 173.05 feet; thence South 54 41'19" West, 120.00 feet; thence North 35 18'41" West, 50.00 feet; thence North 54 41'19" East, 120.00 feet; thence North 35 18'41" West, 824.13 feet to a point on the aforementioned southerly right of way line of N.E. 76th Street; thence South 88 57'08" East, along said southerly line, 435.70 feet to the true point of beginning.

 

Containing 11.63 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

 

Section 6. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
