ORDINANCE NO. 940007
Approving an amendment to a previously approved
preliminary plan in District C-2-p (Local Retail Business - Limited District)
on a 0.75 acre tract of land generally located on the north side of 104th Street
about 500 feet west of Madison Avenue. (10789-P/2)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan in District C-2-p (Local Retail Business - Limited
District) on a 0.75 acre tract of land generally located on the north side of
104th Street about 500 feet west of Madison Avenue, and more specifically
described as follows:
All of Lots 3, 4 and 5, DALLAS, a subdivision of
land in Kansas City, Jackson County, Missouri; and all that part of
the NW 1/4 of the SE 1/4 of Section 31, Township 48, Range 33, Kansas
City, Jackson County, Missouri, being a tract of land 10 feet in width and
lying west of and adjacent to said Lot 3.
is hereby approved, subject to the following conditions:
1. That the developer submit a final plan for
approval, including landscaping and screening.
2. That the developer submit a storm drainage
study to the City Engineer for approval, including provisions for any
needed improvements.
3. That the developer dedicate additional right of
way as required for a total right of way of 30 feet from the
centerline of 104th Street along its tract and
also
dedicate additional right of way as required
for a total
right of way of 30 feet from the centerline of
104th
Street for the 10 foot tract of land east of
"Watts Mill
Auto Repair", as shown on the site plan,
that is in the
same ownership.
4. That the developer construct sidewalks along
the north side of 104th Street.
5. That the developer submit plans for grading and
siltation and erosion control to the City Engineer for approval
prior to the commencement of any construction.
6. That the developer dedicate land within the 100
year floodplain to the Board of Parks and Recreation
Commissioners.
7. That the developer petition for the vacation of
the blanket easement.
8. That the developer combine the existing lots
and the unplatted strip, as shown on the site plan.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 940007, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
