Amending Chapter 80, Code of Ordinances, by
adding a new section to be known as Section 80-11A0149, rezoning an area of
approximately 30 acres generally located north of N.E. 78th Street (proposed),
approximately 500 feet west of N. Church Road extending west to N. Flintlock
Road, from District RA (Agricultural) to District R-3 (Low Density, Low
Apartments). (11661-P-3)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That Chapter 80, Code of
Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the
Zoning Ordinance, is hereby amended by enacting a new section to be known as
Section 80-11A0149, rezoning an area of approximately 30 acres generally
located north of N.E. 78th Street (proposed), approximately 500 feet west of N.
Church Road extending west to N. Flintlock Road, from District RA
(Agricultural) to District R-3 (Low Density, Low Apartments), said section to
read as follows:
Section 80-11A0149. That an area
legally described as:
Commencing at the
southwest corner of the Northwest Quarter of Section 14, Township 51, Range 32,
Clay County, Missouri; thence South 8918'55" East, a distance of 1247.62
feet; thence North 0121'48" East, a distance of 1974.11 feet; to the
point of beginning; thence North 0121'48" East, a distance of 128.14 feet
to a point of curvature; thence on a curve to the right having a central angle
of 3553'06", a radius of 360.00 feet, for a length of 225.47 feet; thence
North 3714'53" East, a distance of 921.01 feet; thence South
6156'19" East, a distance of 1354.54; thence South 2803'41" West, a
distance of 510.89 feet; thence North 8922'15" West, a distance of
1588.91 feet to the point of beginning. Containing 29.27 acres, more or less.
is hereby rezoned from District RA
(Agricultural) to District R-3 (Low Density, Low Apartments), all as shown
outlined on a map marked Section 80-11A0149, which is attached hereto and made
a part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
