Approving a Community Unit
Project on an approximately 1.14 acre tract of land generally located on both
sides of E. 30th Street, east of Campbell Street. (13264-CUP)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
a Community Unit Project on an approximately 1.14 acre tract of land generally
located on both sides of E. 30th Street, east of Campbell Street,
and more specifically described as follows:
All that part of Lots 1, 2, 3
and 4 and that part of the vacated alley East of and adjoining Lots 2, 3 and 4
described as follows: Beginning at the Southwest corner of Lot 2, thence East
along the North line of 30th Street 167 feet, thence North 121.58 feet to a
point in a line drawn 10 feet North of and parallel to the South line of Lot 4,
thence West along said parallel line 167 feet to the East line of Campbell
Street, thence South along the East side of Campbell Street to the point of
beginning, in Block 1, CRESTON, a subdivision in Kansas City, Jackson County,
Missouri.
TRACT I: The East 50 feet of Lot
1, Block 1, CRESTON, a subdivision in Kansas City, Jackson County, Missouri.
TRACT II: The West 55 feet of
the East 105 feet of Lot 1, Block 1, CRESTON, a subdivision in Kansas City,
Jackson County, Missouri.
TRACT III: The West 55 feet of
the East 160 feet of Lot 1, Block 1, CRESTON, a subdivision in Kansas City,
Jackson County, Missouri.
The North 50 feet of Lot 1, Block 6, CRESTON, a subdivision
in Kansas City, Jackson County, Missouri.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri,
commonly known as the Subdivision Regulations.
2.
That the developer improve the north-south alley to a minimum paved
width of 16 feet and enter into a maintenance agreement for the alley as required
by the Department of Public Works.
3.
That the developer submit a detailed micro storm drainage study,
consisting at a minimum of a letter from a Missouri licensed civil engineer
stating that the proposed improvements will not alter or increase historical
runoff conditions for the site, to the City Engineers Office prior to approval
and issuance of any building permits, and that the developer make any
improvements as required by the City Engineers Office.
4.
That the developer secure permits to construct or reconstruct existing
sidewalks, curbs and gutter, inlets, catch basins and streetlights as necessary
along all development street frontages as required by the Department of Public
Works, prior to recording the plat.
5.
That the developer submit plans for grading and siltation and erosion
control to the City Engineers Office for approval prior to beginning any
construction activities.
6.
That any relocated streetlights be integrated into the existing street
light system as required by the Department of Public Works.
7. That
the developer obtain a site disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
8.
That the developer extend sanitary sewers to ensure individual service
is provided to all proposed lots and determine adequacy as required by the
Department of Public Works
9.
That the developer provide a storm water conveyance system to serve all
proposed lots within the development and determine adequacy as required by the
Department of Public Works.
10.
That the developer contribute $3,744.71 in lieu of parkland dedication
for 4 single-family units, 6 duplex units and 8 multifamily units (4 x 3.7 + 6
x 3 + 8 x 2) x .006 X $12,789.30 = $3,744.71) in satisfaction of Section 66-128
of the Subdivision Regulations.
11.
That the developer provide for fire protection as required by the Fire
Department prior to construction beyond foundations.
12.
That the developer extend water mains as required by the Water Services
Department.
13.
That the developer receive the approval of the Board of Zoning Adjustment
for any necessary variances.
14.
That the developer submit
a street tree planting plan as part of the final plat, secure the approval of
the City Forester for street trees planted on right-of-way in front of
residential lots (with a copy to be submitted to the City Development
Department staff), and agree to plant in conformance with the plan approved by
the City Forester. The plan shall include size, type, species, and placement
of trees.
15.
That the developer submit a final plan to the City Plan Commission for
approval, including detailed information on landscaping, signage (including
elevations), and building elevations.
A copy of said Community Unit
Project plan is on file in the office of the City Clerk with this ordinance,
which is attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
Community Unit Project hereinabove, all public notices and hearings required by
the Zoning Ordinance have been given and had.
