ORDINANCE NO. 930711

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2475, rezoning an area generally located on the south side of Tiffany Springs Road approximately one-fourth mile west of N. Green Hills Road from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density, Residential Uses), and approving a development plan for the same.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2475, rezoning an area generally located on the south side of Tiffany Springs Road approximately one-fourth mile west of N. Green Hills Road from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density, Residential Uses), said section to read as follows:

 

Section 65.010A2475. That an area legally described as:

 

A tract of land in the West One-Half of Section 5, Township 51, Range 33, Kansas City, Platte County, Missouri, being bounded and described as follows: Beginning at the southwest corner of the Northwest Quarter of said Section 5; thence North 025'58" East, along the west line of the Northwest Quarter of said Section 5, 52.16 feet; thence northeasterly along a curve to the left, having an initial tangent bearing of North 8002'34" East, a radius of 660.00 feet, an arc distance of 460.94 feet; thence North 4001'40" East, 100.01 feet; thence northeasterly along a curve to the right, tangent to the last described course, having a radius of 740.00 feet, an arc distance of 395.20 feet; thence South 8812'46" East, 234.09 feet to a point on the southwesterly right of way line of the Kansas City, Clay County and St. Joseph Railroad (now abandoned); thence southeasterly along said southwesterly line on a curve to the left, having an initial tangent bearing of South 2730'23" East, a radius of 11,492.20 feet, an arc distance of 1,919.24 feet; thence South 3704'30" East, along said southwesterly line, 3.02 feet; thence North 8812'46" West, 819.58 feet; thence North 3642'09" West, 1,443.97 feet; thence southwesterly along a cure to the right, having an initial tangent bearing of South 5042'39" West, a radius of 740.00 feet; an arc distance of 393.49 feet to a point on the aforementioned west line of said Northwest Quarter; thence North 025'58" East, along said west line, 29.03 feet to the point of beginning. Containing 29.67 acres, more or less.

 

is hereby rezoned from District GP-7 (Agricultural and Low Density, Residential Uses) to District GP-5 (Medium Density, Residential Uses), all as shown outlined on a map marked Section 65.010A2475, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval.

 

3. That the developer submit site grading plans and plans for the control of erosion and siltation to the City

Engineer's Office for approval.

 

4. That the developer dedicate 80 feet of right of way for the relocated Tiffany Springs Road.

 

5. That the developer construct two lanes of the relocated Tiffany Springs Road to secondary arterial street

standards.

 

6. That the developer petition for the vacation of the existing Tiffany Springs Road.

 

7. That the developer obtain the necessary off-site right of way for the relocation of Tiffany Springs Road.

 

8. That the developer construct temporary cul-de-sacs as required.

 

9. That the developer extend water mains as required by the Water Department.

 

10. That the developer contribute money in lieu of parkland dedication in satisfaction of Section 31.32 in the amount

of $12,561.53 (90 x 3.7 x .006 x $6,287.05).

 

11. That the developer construct the entry street to a 36 foot width or that the developer construct two divided 18

foot wide lanes from the relocated Tiffany Springs Road

to the first street intersection.

 

A copy of said development plan is on file in the Office of the City Clerk under Document No. 930711, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
