Approving an amendment to a previously approved
development plan in District GP-3 (Regional Business) on approximately a 41.5
acre tract of land generally located on both sides of N.W. Donovan Drive, west
of I-29, to delete therefrom approximately 2.1 acres. (5935-GP-6)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved development plan in District GP-3 (Regional Business) on approximately
a 41.5 acre tract of land generally located on both sides of N.W. Donovan
Drive, west of I-29, and more specifically described as follows:
That part of the Southeast Quarter of Section 1,
Township 51 North, Range 34 West of the 5th P.M. Kansas City, Platte
County, Missouri described as follows: Beginning at the point of
intersection of the southerly right of way line of N.W. Tiffany Springs
Road and the west line of said Southeast Quarter being 30 feet south of the
northwest corner of said Southeast Quarter; thence south on said west
line, 1423 feet more or less to the westerly prolongation of the south
line of Lot 1, The Lakes Executive Hills North, a subdivision of land in
Kansas City, Platte County, Missouri; thence east on said westerly
prolongation, 370 feet, more or less, to the southwest corner of said Lot
1; thence north on the west line of said Lot 1 to the southerly right of way
line of said Donovan Drive; thence easterly on said southerly right of way
line to the northeast corner of said Lot 1; thence south on the east line
of said Lot 1, to the southeast corner of said Lot 1, also being a point
on the south line of Lot 2, Barron International Plaza, a subdivision of
land in Kansas City, Platte County, Missouri; thence east on said south
line 210 feet to the southeast corner of said Lot 2; thence north on the
easterly line of said Lot 2, 313 feet to the southerly line of said Lot 2;
thence easterly on said southerly line, 190 feet, more or less, to a point on
the westerly right of way line of Interstate Highway 29; thence northerly
on said westerly right of way line, 159 feet, more or less, to the
southerly right of way line of said Donovan Drive; thence easterly on said
southerly right of way line, 28 feet, more or less, to the westerly right
of way line of said Interstate Highway 29; thence northwesterly on said
westerly right of way line to the southerly right of way line of said N.W.
Tiffany Springs Road; thence westerly on said southerly right of way line
to the point of beginning. Tract contains 41.5 acres, more or less.
for the purpose of deleting therefrom 2.1 acres so that
the remaining parcel is more specifically described as follows:

the westerly right of way line of Interstate Highway 29; thence northerly

southerly right of way line of said Donovan Drive; thence easterly on said
southerly right of way line, 28 feet, more or less, to the westerly right
of way line of said Interstate Highway 29; thence northwesterly on said
westerly right of way line to the southerly right of way line of said N.W.
Tiffany Springs Road; thence westerly on said southerly right of way line
to the point of beginning. Tract contains 41.5 acres, more or less.
Except that part described as Parcel A described as
follows: All that part of Lot 2, Barron International Plaza, a subdivision
of land in the City of Kansas City, Platte County, Missouri, described as
follows: Beginning at the southeast corner of said Lot 2; thence North 89
57'34" West, along the south line of said Lot 2, a distance of 210.00
feet; thence North 00 16'03" East, along a line parallel with the east
line of said Lot 2, a distance of 335.66 feet to a point on the north line
of said Lot 2, said point also being on the southerly right of way line of
Donovan Drive; thence easterly along said northerly line of said Lot 2,
also being the southerly right of way line of Donovan Drive, along a curve
to the left, having an initial tangent bearing of North 83 04'58"
West, and a radius of 449.47 feet, an arc distance of 250.46 feet; thence
North 64 59'25" East, along the above described line, a distance of 214.89
feet, to a point on the westerly right of way line of U.S. Interstate
Highway Route No. I-29; thence South 14 11'02" West, along the
westerly, right of way line of U.S. Interstate Highway Route No. I-29, a
distance of 157.46 feet, to the southerly line of said Lot 2; thence North
89 57'34" West, along the south line of said Lot 2, a distance of
190.42 feet to the easterly line of said Lot 2; thence South 00 16'03"
West along the westerly line of said Lot 2, a distance of 313.00 feet, to
the point of beginning.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for the entire development for
approval and that the developer make any improvements
as required by the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
5. That the developer dedicate additional right of
way for N. Congress Avenue as required by the Department of Public
Works so as to provide a total of 40 feet of
right of way as measured from the centerline of
N. Congress Avenue.
6. That the developer improve one-half of N.
Congress Avenue to secondary arterial street standards as required by
the Department of Public Works.
7. That the developer dedicate additional right of
way for Tiffany Springs Road as required by the Department of Public
Works so as to provide a total of 50 feet of
right of way as measured from the centerline of
Tiffany Springs Road.
8. That the developer improve one-half of Tiffany
Springs Road to secondary arterial street standards as required by
the Department of Public Works.
9. That the developer dedicate additional right of
way for N.W. Donovan Drive as required by the Department of Public
Works so as to provide a total of 30 feet of
right of way as measured from the centerline of
N.W. Donovan Drive.
10. That the developer improve N.W. Donovan Drive
to collector street standards as required by the Department of Public
Works.
11. That the developer receive the approval of the
Missouri Highway and Transportation Department prior to working in
any State right of way.
12. That the developer extend sanitary sewers as
required by the Department of Public Works.
13. That the developer extend water mains as
required by the Water Services Department.
14. That the developer construct all buildings and
structures so as to comply with the KCI Airport Height Zoning
restrictions.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 970242, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
