COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060398

 

Rezoning an area of approximately 1.9 acres generally bounded by 18th Street, Central Street, 19th Street and Broadway Boulevard from District M-1 to District URD, and approving a development plan for the same. (13525-URD)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0671, rezoning an area of approximately 1.9 acres generally bounded by 18th Street, Central Street, 19th Street and Broadway Boulevard from District M-1 (Light Industry) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0671. That an area legally described as:

 

TRACT I: All of Lots 1,2,3,4,5,6,7,8,9,10,11,12,13,14,15,27,28,29 and 30 and all of the 16-foot vacated alley lying East of and adjacent to Lots 1 to 11, inclusive, and West of and adjacent to Lots 12 and 30, and all of the 25-foot vacated alley lying South and adjacent to Lots 12 to 15, inclusive, and North of and adjacent to Lots 27 to 30, inclusive, all in Block 8, Goodrich Addition, a Subdivision in Kansas City, Jackson County, Missouri.

 

TRACT II: Lot 20, except the North 3.55 feet thereof, and all of Lots 21,22,23,24,25 and 26, Block 8, Goodrich Addition, a Subdivision in Kansas City, Jackson County, Missouri.

 

Together with all of the 15-foot alley (to be vacated) lying West of and adjacent to Lot 20 except the North 3.55 feet, Lots 21, 22, 23, 24, 25 and 26, Block 8, Goodrich Addition, a Subdivision in Kansas City, Jackson County, Missouri.

 

Together with all of the West half of the 15-foot alley (to be vacated) lying West of and adjacent to Lots 16, 17, 18, 19 and the North 3.55 feet of Lot 20, Block 8, Goodrich Addition, a Subdivision in Kansas City, Jackson County, Missouri.

 

More particularly described as follows: Beginning at the Northwest corner of Lot 1, Block 8, Goodrich Addition, a Subdivision in Kansas City, Jackson County, Missouri, according to recorded plat thereof; thence S895956E, along the South Right-of-Way line of 18th Street, a distance of 223.47 feet; thence S001258E, a distance of 111.42 feet; thence N900000E, a distance of 107.46 feet, to a point on the West Right-of-Way line of Central Street; thence S001231E, along said West Right-of-Way line of Central Street, a distance of 171.25 feet, to a point on the North Right-of-Way line of 19th Street; thence N900000W, along said North Right-of-Way line of 19th Street, a distance of 330.82 feet, to a point on the East Right-of-Way line of Broadway Boulevard; thence N001407W, along said East Right-of-Way line of Broadway Boulevard, a distance of 282.68 feet to the point of beginning, said tract containing 81,556 square feet or 1.87 acres more or less.

 

is hereby rezoned from District M-1 (Light Industry) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0671, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                 That the developer cause the area to platted and processed in accordance to Chapter 66, Code of General Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer petition for the vacation of the north-south alley as shown on the development plan as required by Development Services prior to filing the final plat application.

 

3. That the developer secure permits to reconstruct existing sidewalks, curb, gutter, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri Licensed Civil Engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

4. That any relocated streetlights be integrated into the existing street light system as required by Development Services.

 

5. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

6. That the developer submit a streetscape plan for approval and permitting by Development Services prior to beginning work in the public right of way.

 

7. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements and private open space tracts, if applicable.

 

8. That the developer provide for fire protection as required by the Fire Department.

 

9. That the developer contribute $119.54 / unit in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations.

 

10. That the developer comply with the Kansas City Wheeler Airport Height Zoning restrictions and that this language be included on the final plat.

 

11. That the developer apply for an encroachment resolution from the Board of Parks and Recreation Commissions for any encroachment in Broadway Boulevard.

12. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the issuance of a building permit. The site plan shall include information regarding: property uses, setback distances, lighting, landscaping and architectural characteristics, berms, trees and plantings around and within the parking lots; show proposed pedestrian circulation; and include elevation drawings of buildings and signage.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
