COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970611

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0054, rezoning an area of approximately 72 acres generally located on the north side of N.W. Cookingham Drive, approximately 350 feet west of N. Congress Avenue/N.W. Interurban Road (west of Ferrelview), from District GP-7 (Agricultural and Low Density Residential Uses) to GP-5 (Medium Density Residential Uses), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0054, rezoning an area of approximately 72 acres generally located on the north side of N.W. Cookingham Drive, approximately 350 feet west of N. Congress Avenue/N.W. Interurban Road (west of Ferrelview), from District GP-7 (Agricultural and Low Density Residential Uses) to GP-5 (Medium Density Residential Uses), said section to read as follows:

 

Section 80-11A0054. That an area legally described as:

 

A tract of land in the Southeast Quarter and the Southwest Quarter of Section 13, Township 52, Range 34, Kansas City, Platte County, Missouri, being described as follows: Beginning at the intersection of the west line of Ferrelview, a subdivision of land in Platte County, Missouri, and the northerly right of way line of Missouri Route 291, as now established; thence North 89 25'53" West, along said northerly right of way line, 193.85 feet; thence North 54 42'46" West, along said northerly right of way line, 108.16 feet; thence North 16 52'02" West, along said northerly right of way line, 262.98 feet; thence North 44 35'28" West, along said northerly right of way line, 253.85 feet; thence North 54 48'26" West, along said northerly right of way line, 255.20 feet; thence North 71 44'14" West, along said northerly right of way line, 185.89 feet; thence North 82 57'51" West, along said northerly right of way line, 568.22 feet to its intersection with the west line of the east 72.5 acres of the west 145 acres of said Southwest Quarter; thence North 0 22'49" East, along said west line, 1867.46 feet to a point on the north line of said Southwest Quarter; thence South 89 25'53" East, along the north line of said Southwest Quarter and said Southeast Quarter, 1490.77 to the west line of said Ferrelview; thence South 0 22'49" West, along said west line, 2624.46 feet to the point of beginning. Containing 71.24 acres more or less. Excepted tract herein described: A tract of land lying partially in the Southeast Quarter of Section 13, Township 52, Range 34, Platte County, Missouri, and lying partially in the Southwest Quarter of Section 13, Township 52, Range 34, Platte County, Missouri, being more accurately described as follows: Beginning at a point on the east line of the southeast corner of the Southwest Quarter of said Section 13, as measured along said east line; thence North 89 36'05" West, 231.17 feet; thence North 0 16'49" East, 300.00 feet; thence South 89 36'05" East, 233.67 feet, to a point on the east line of the Southwest Quarter of said Section 13; thence South 89 36'05" East, on a continuation of the last described course 16.33 feet to a point in the west line of the City of Ferrelview, as the same is now located; thence South 0 16'49" West, along the west line of the city of the City of Ferrelview, 300.00 feet; thence North 89 36'05" West, 18.83 feet to the point of beginning.

 

is hereby rezoned from District GP-7 (Agricultural and Low Density Residential Uses) to GP-5 (Medium Density Residential Uses), all as shown outlined on a map marked Section 80-11A0054, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any necessary improvements as required by the City Engineer's

Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure a floodplain certificate if grading is to occur within a floodplain.

 

6. That the developer comply with the Kansas City International Airport Height Zoning restrictions and that the requirements for such restrictions be included on the final

plat.

 

7. That the developer grant a Noise and Aviation Easement to the City.

 

8. That the developer submit a traffic study to the Department of Public Works and to the Missouri Highway and Transportation Department for approval, analyzing the

impact of this development upon the intersection of N.W. Cookingham Drive and the

frontage road, and that the developer make any necessary improvements as required

by the approved traffic study.

 

9. That the developer dedicate additional right of way for N.W. Cookingham Drive as required by the Department of Public Works so as to provide a total of 50 feet of

right of way as measured from the centerline of N.W. Cookingham Drive.

 

10. That the developer construct all interior private streets to public street standards, including construction of sidewalks on one side of the street, as required by the

Department of Public Works.

 

11. That the developer receive the approval of the Missouri Highway and Transportation Department prior to working within any State right of way.

 

12. That the developer receive the approval of the Missouri Highway and Transportation Department for access locations onto the frontage road.

 

13. That the developer construct cul-de-sacs as required by the Department of Public Works.

 

14. That the developer submit a street name signage plan to the Street Naming Committee for approval before the first final plat is submitted.

 

15. That the developer define the limits of the 100 year floodplain on the final plats.

 

16. That the developer extend water mains as required by the Water Services Department.

 

17. That the developer extend sanitary sewers as required by the Department of Public Works.

 

18. That the developer construct all-weather roads and provide for fire protection as required by the Fire Department.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 970611, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
