COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070260

 

Approving the preliminary plat of SSP Addition on a 1.85 acre tract of land generally located on the south side of U.S. Highway 40 and west of Pittman Road. (SD 1296)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of SSP Addition on a 1.85 acre tract of land generally located on the south side of U.S. Highway 40 and west of Pittman Road, and more specifically described as follows:

 

The North 112.00 feet of Lots 6, 7 & 8, SOUTH HOLLYWOOD and part of Lots 158, 159, 160 and 161, EAST HOLLYWOOD, subdivisions in Kansas City and Independence, Jackson County, Missouri being described as follows: Beginning at the Northeast corner of said Lot 6; thence South 1 degree 54 minutes 51 seconds West, along the East line of said Lot 6, 112.00 feet to the Southeast corner of the North 112.00 feet of said Lot 6; thence North 86 degrees 42 minutes 39 seconds West, along the South line of the North 112.00 feet of said Lots 6, 7 & 8, 270.00 feet to the Southwest corner of the North 112.00 feet of said Lot 8; thence North 1 degree 54 minutes 51 seconds East, along the West line of said Lot 8, 112.00 feet to the Northwest corner of said Lot 8; thence South 86 degrees 42 minutes 39 seconds East, along the South line of said Lot 161, 16.00 feet; thence North 25 degrees 11 minutes 47 seconds East, 107.37 feet; thence North 9 degrees 09 minutes 24 seconds East, 46.42 feet; thence North 73 degrees 27 minutes 16 seconds West, at right angles to a line drawn from a point on the West line of said Lot 160 that is 120.00 feet North of the Southwest corner thereof to a point on the Southwesterly right of way line of U.S. Highway No. 40 that is 73.21 feet West of the Northeast corner of said Lot, 19.81 feet to said line; thence North 16 degrees 32 minutes 44 seconds East, along said line, 102.27 feet to said Southwesterly right of way line; thence South 62 degrees 44 minutes 24 seconds East, along said Southwesterly right of way line 80.00 feet Southwesterly of and parallel with the Centerline thereof, 150.00 feet; thence North 27 degrees 15 minutes 36 seconds East, continuing along said Southwesterly right of way line, 5.00 feet, thence South 62 degrees 44 minutes 24 seconds East, continuing along said Southwesterly right of way line, 75.00 feet Southwesterly of and parallel with the center line thereof, 127.67 feet; thence south 27 degrees 29 minutes 14 seconds West, 98.87 feet; thence South 14 degrees 30 minutes 29 seconds West, 52.46 feet to the POINT OF BEGINNING, containing 1.848 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

3.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

4.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

5.                  That the developer pay money in lieu of parkland dedication in the amount of $442.30 prior to recording of the final plat

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
