ORDINANCE NO. 990307

 

Amending Section 2-1012.5, Code of Ordinances, to include within the orientation received by persons elected to the Council or as Mayor, information on the ordinance process and information on their rights and responsibilities as elected officials.

 

WHEREAS, a special Council Ethics/Relations Committee was appointed by the Mayor to develop guidance for the City Council on the proper interaction between the Council and City staff and to improve ethics in City government; and

 

WHEREAS, during 1997 and 1998 the Council Ethics/Relations Committee met with former Mayors, Council members, City staff, the United States Attorney, and members of the public to study the issues and learn of opportunities available to the Council to accomplish its charge; and

 

WHEREAS, the Council Ethics/Relations Committee has concluded that providing specific training to newly elected officials on the legislative process and the rights and responsibilities of elected officials will benefit each member of the Council, the Council as an institution, and the people of the City of Kansas City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 2-1012.5, Code of Ordinances, is amended to read as follows:

 

Sec. 2‑1012.5. Orientation training.

 

(a) A person shall receive orientation training on ethics after election as either a council member or mayor and before the city clerk administers the oath of office to that council member or mayor. It shall be the responsibility of the city manager to provide this training which shall include: legislative procedures; applicable sections of Chapter 105, Revised Statutes of Missouri (Conflict of Interest and Missouri Ethics Commission); Chapter 130, Revised Statutes of Missouri (Campaign Finance Disclosure); Chapter 610, Revised Statutes of Missouri (the Sunshine Law); and Chapter 2, Article VII, Division 2 of the Code of Ordinances of Kansas City, Missouri (the Ethics Code).

 

(b) The city manager shall furnish each council member‑elect and the mayor‑elect with a written synopsis of the functions and responsibilities of each city department and a synopsis of the city financing sources, including definitions of terms. Council members‑elect and the mayor‑elect will have the opportunity to meet with each department head and receive orientation on that department's functions and responsibilities and to meet with the director of human resources and receive orientation on salary and benefits.

 

(c) The city attorney shall provide an explanation of the procedures required by law to enact the types of legislation that may be considered by the Council.

 

(d) The city attorney shall provide an explanation of the rights and responsibilities of elected officials insofar as those subjects are not included in the orientation provided by subsection (a) of this section.

 

(e) Updates on orientation training topics shall be furnished to council members and the mayor by the city manager every six months.
