ORDINANCE NO. 970870
Amending Chapter 80, Code of Ordinances of the City of
Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding
a new section to be known as Section 80-11A0070, rezoning an area of
approximately 9.6 acres generally located on the west side of Troost Avenue,
approximately 800 feet north of 89th Street, from District RA (Agricultural) to
District PD/RA (Planned District/Agricultural), and approving a development
plan for the same. (8835-PD-2)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, 1996, commonly known as the Zoning
Ordinance, is hereby amended by enacting a new section to be known as Section
80-11A0070, rezoning an area of approximately 9.6 acres generally located on
the west side of Troost Avenue, approximately 800 feet north of 89th Street,
from District RA (Agricultural) to District PD/RA (Planned District/Agricultural),
said section to read as follows:
Section 80-11A0070. That an area legally described
as:
A tract of land being part of Lots 1, 2, 7 and 8,
and part of vacated 87th Street, South Troost Hill, a subdivision in
Kansas City, Jackson County, Missouri described as follows: Beginning at a
point on the east line of the SE 1/4 of Section 20, Township 48, Range 33,
said point being South 02 04'31" West, along said line, 212.45 feet
from the northeast corner of said SE 1/4; thence North 87 55'29" West,
176.19 feet; thence North 74 55'48" West, 182.05 feet; thence North
03 02'21" East, 177.44 feet to a point on the north line of said SE
1/4, said point being North 86 57'39" West, along said line, 350.64
feet from the northeast corner of said SE 1/4; thence North 86 57'39"
West, along said line and along the north line of vacated 87th Street,
524.33 feet; thence South 03 02'21" West, 335.23 feet; thence South 59
53'04" East, 84.76 feet; thence South 26 52'57" West, 25.47
feet; thence South 61 53'42" East, 269.60 feet; thence southeasterly,
along a curve to the left having a radius of 19.30 feet and an initial
tangent bearing of South 26 28'50" West, an arc distance of 29.81
feet; thence South 62 01'24" East, 296.79 feet, more or less, to the south
line of said Lot 2; thence South 86 54'32" East, along said line and
its easterly prolongation, 298.03 feet, more or less, to the east line of
said SE 1/4; thence North 02 04'31" East, along said line, 449.55
feet, more or less, to the point of beginning. Except the east 74.50 feet
now in the right of way of Troost Avenue.
is hereby rezoned from District RA (Agricultural) to
District PD/RA (Planned District/Agricultural), all as shown outlined on a map
marked Section 80-11A0070, which is attached hereto and made a part hereof, and
which is hereby adopted as a part of an amendment to the zoning maps
constituting a part of said chapter and as an amendment to Section 80-11 thereof.
Section B. That a development plan for the area
legally described above is hereby approved. A copy of said development plan is
on file in the office of the City Clerk under Document No. 970870, which is
attached hereto and made a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
