COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060267

 

 Dedicating City owned property for public purposes for the construction of a sanitary sewer in connection with the Shoal Creek Police Academy, located in the vicinity of NE Pleasant Valley Road and NE Shoal Creek Parkway, all in Kansas City, Clay County, Missouri, and directing the City Clerk to record this ordinance.

WHEREAS, a portion of property owned by the City is needed for the construction of said sanitary sewer; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City hereby dedicates a portion of the property for public purposes as described below:

A strip of land 15.0 feet wide (the Dedication), through a part of the Southeast Quarter of Section 21, Township 51 North, Range 32 West, in Kansas City, Clay County, Missouri, lying 7.5 feet on each side of the following described centerline.

 

Commencing at the Northwest corner of said Southeast Quarter; thence South 89 degrees 44 minutes 49 seconds East along the north line of said Southeast Quarter, 553.48 feet to the Point of Beginning; thence South 0 degrees 03 minutes 23 seconds West, 229.06 feet; thence South 01 degrees 34 minutes 34 seconds East, 374.08 feet; thence South 42 degrees 58 minutes 35 seconds West, 184.90 feet; thence South 0 degrees 09 minutes 38 seconds West; 310.91 feet; thence South 0 degrees 03 minutes 31 seconds West, 331.25 feet; thence South 24 degrees 26 minutes 48 seconds West, 322.23 feet; thence South 4 degrees 42 minutes 51 seconds East, 375.68 feet; thence South 13 degrees 48 minutes 17 seconds East, 378.69 feet; thence South 16 degrees 00 minutes 34 seconds East, 272.30 feet; thence South 19 degrees 02 minutes 13 seconds East, 261.61 feet; thence South 12 degrees 14 minutes 18 seconds East, 125.00 feet to the Point of Beginning, containing 47,486.00 square feet, more or less.


Section 2. The Dedication shall be used by Kansas City for sanitary sewer improvements and any necessary appurtenances; and Kansas City shall have the right to enter upon the Dedication for the purpose of constructing, reconstructing, maintaining, operating and repairing said improvements or making connections thereto.

Section 3. There shall be reserved to the owners of the land the right to use the land in any way which will not interfere with the proper, safe and continuous use of the sanitary sewer facilities to be constructed in and upon such Dedication.

Section 4. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Clay County, Missouri.
