COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 020094

 

Approving the preliminary plat of Stadium Industrial Park III on approximately a 13.23 acre tract of land generally located north of Stadium Drive and west of Enterprise Drive. (SD 0627D)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Stadium Industrial Park III on approximately a 13.23 acre tract of land generally located north of Stadium Drive and west of Enterprise Drive, and more specifically described as follows:

 

Commencing at the northeast corner of the Northeast Quarter of Section 24; then South 2E10'38" West on the east line of said Northeast Quarter of Section 24, a distance of 600 feet; then North 84E25'56" West, 159.19 feet; then South 2E13'31" West, 30.05 feet to a point on the south line of Tract C, Stadium Industrial Park, a subdivision in Kansas City, Jackson County, Missouri, for a true point of beginning; then South 84E25'56" East on the south line of said Tract C, 183.32 feet to the southwest corner of Tract D, Stadium Industrial Park II, a subdivision in Kansas City, Jackson County, Missouri; then easterly on the south line of said Tract D, the following four course: South 84E25'56" East, 246.85 feet; North 17E25'56" West, 32.59 feet, South 84E25"56" East, 73.90 feet; South 43E20'27" East, 94.43 feet to the southwest corner of Lot 2, Stadium Industrial Park II; then southeasterly on the southerly line of Lot 2, the following two courses: South 43E20'27" East, 156.37 feet; South 74E18'25" East, 272 feet to the northwest corner of Tract E, Stadium Industrial Park II; then South 2E13'26" West on the west line of said Tract E and its southerly prolongation, 722 feet (733.5 feet deeded) to a point on the centerline of Stadium Drive (formerly known as Leeds Road) as now established; then northwesterly on the said centerline, the following five courses: North 58E02'54" West, 419.71 (7.98 feet and 424.9 feet deeded) feet to a point of curvature; northwesterly on a curve to the left with a radius of 975.60 feet and an arc distance of 125.15 feet to a point of tangency; North 65E23'54" West, 71.08 feet to a point of curvature; northwesterly on a curve to the left with a radius of 363.56 feet and an arc distance of 164.56 feet to a point of tangency; thence South 88E40'06" West, 12.24 feet (deeded South 86E30' West 12.2 feet) then North 13E15'04" East, 32.71 feet to the southeast corner of a Certificate of Survey filed as Document K-0012224 in Book 95 at page 58 at the Recorder of Deeds Office in Kansas City, Jackson County, Missouri; then northerly and northwesterly on the easterly line of said Certificate, the following seven courses: North 13E15'04" East, 77.64 feet; North 76E44'56" West, 150 feet; North 3E47'20" East, 152.07 feet; North 76E44'56" West, 100 feet; North 7E29'29" West, 237 feet; South 87E46'29" East, 40 feet; North 2E13'31 East, 95.26 feet to the northeast corner thereof; then continuing North 2E13'31" East on the southerly line of said Tract C, Stadium Industrial Park, 6.62 feet to the point of beginning, except that part in Stadium Drive (formerly Leeds Road).


is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer provide for fire protection as required by the Fire Department.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer dedicate additional right of way for Stadium Drive as required by the Department of Public Works so as to provide 50 feet of right of way as measured from the centerline of Stadium Drive.

 

10. That the developer enter into a Deferral Agreement with the City as required by the Department of Public Works whereby the developer agrees to improve one-half (the north side) of Stadium Drive to primary arterial street standards, including construction of curb, gutter and sidewalks and installation of streetlights, at such time as Stadium Drive is improved on the south side.

 


A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 020094, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
