COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 180080

 

Rezoning an area of approximately 2 acres generally bounded by 7th Street, 8th Street, Main Street, and Baltimore Avenue, from District DC-15 to District UR, and approving a development plan to allow renovation of a former office building into a 184-unit residential building (14270-UR-3).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1136, rezoning an area of approximately 2 acres generally bounded by 7th Street, 8th Street, Main Street, and Baltimore Avenue, from District DC-15 (Downtown Core) to District UR (Urban Redevelopment), said section to read as follows:

 

Section 88-20A1136. That an area legally described as:

 

Tract 2:

 

Parcel A: Lots 13, 14, 15 and the South 16.30 feet of lot 16, block 3, T.H. Swope’s 2nd Addition, and that part of the vacated alley lying west of and adjoining and lying east of the east line of Baltimore Avenue, formerly Ann Street, as established by Ordinance No. 5253 approved April 9, 1872, together with a part of Delaware Street east and adjoining as vacated by Ordinance No. 41284 passed June 2, 1972, all in Kansas City, Jackson County, Missouri.

 

Parcel B: Lots 14 to 18, both inclusive, Ross and Scarritt’s Addition, and that part of lot 19 in said addition lying south of the easterly prolongation of a line drawn 16.30 feet north at right angles from the south line of Lot 16, Block 3, in T.J. Swope’s 2nd Addition; together with that part of Delaware Street and 8th Street lying south of said easterly prolongation as vacated by Ordinance No. 24054 passed July 2, 1959, and by Ordinance No. 41284 passed June 2, 1972, excepting from the above described tract part of said lots now in Main Street.

 

is hereby rezoned from District DC-15 (Downtown Core) to District UR (Urban Redevelopment), all as shown outlined on a map marked Section 88-20A1136, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  The developer shall secure approval of a final development plan from the Development Management Division prior to building permit. The plan shall include the following:

 

a.                   Landscape plan showing street trees along each street frontage as required by the Zoning and Development Code.

 

b.                  Fully-dimensioned, detailed site plan.

 

c.                   Sign plan, if any signs are proposed at that time.

 

d.                  Details on the fencing for the proposed dog park.

 

2.                  Prior to issuance of a building permit the developer shall be responsible for parkland, private open space in lieu of parkland, or payment of cash-in-lieu of parkland dedication, or any combination thereof. The minimum area required shall be based upon the following formula (number of residential units X 2 persons per unit X 0.006 acres = required dedication in acres). Should the developer choose to pay cash-in-lieu of dedicating all or a portion of the required area, the amount due shall be based upon the 2017 acquisition rate of $37,662.28 per acre.

 

3.                  The developer shall submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, identifying sidewalks, curbs, and gutters in disrepair as defined by Public Works Department’s "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised 4/8/09" and based on compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters where said letter shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and/or to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Land Development Division and prior to issuance of any certificate of occupancy permits including temporary certificate of occupancy permits.

 

4.                  The developer shall submit an analysis to verify adequate capacity of the existing sewer system as required by the Land Development Division prior to issuance of a building permit to connect the private system to the public sewer main and depending on adequacy of the receiving system, make other improvements as may be required.

 

5.                  Change in use from an office to 184 residential units. Obtain a Certificate of Occupancy for the residential use prior to occupying.

 

6.                  Buildings equipped with a fire standpipe system shall have an operable fire hydrant within 100 feet of the Fire Department Connection (FDC). (IFC2012: § 507.5.1.1).

 

7.                  Any significant occupancy type change shall be done in conformance with the applicable building codes which are in effect at the time of the change with a valid certificate of occupancy issued by the City Planning and Development Department.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
