ORDINANCE NO. 990130

 

Repealing Ordinance No. 981091, passed September 17, 1998, and approving and authorizing execution of a lease agreement with Williams Communications, Inc., for the leasing of space on, over and under the Old Railroad Bridge West of Kemper Arena over the Kansas River and the land immediately east of the Bridge, for the purpose of construction of an 8 inch galvanized iron conduit for fiber optic cable over and through City property for a term of twenty years with a ten-year option to renew.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 981091, passed September 17, 1998, is hereby repealed and the authority for the Director of the Department of City Development to execute the lease agreement is hereby rescinded.

 

Section 2. That the Director of the Department of City Development is hereby authorized, on behalf of the City, to execute a lease agreement with Williams Communications, Inc., for the leasing of space, on, over and under City property generally located at the Old Railroad Bridge west of Kemper Arena over the Kansas River and the land immediately east of the Bridge, in Kansas City, Wyandotte County, Kansas, and more particularly described as follows:

 

A parcel of land situated in the South Half of Section 15, Township 11 South, Range 25 East, County of Wyandotte, State of Kansas, described as follows: All of the land described in deed dated August 10, 1887, from Kansas City Stock Yards Company to The Kansas City & Topeka Railway Company, filed for record October 12, 1887, in Book 82, page 1, records of said County.

 

Also, a portion of the land described in Second Parcel of deed dated August 10, 1887, from Kaw Valley Town Site & Bridge Company to The Kansas City & Topeka Railway Company recorded October 12, 1887, in Book 82, page 4, records of said County, said portion bounded as follows: Northerly by the southerly line of that certain 1.746 acre parcel of land described in deed dated June 30, 1967, from Chicago Rock Island and Pacific Railroad Company to Kansas City Stock Yards Company of Maine recorded July 7, 1967, in Book 2050, page 391, Document No. 714387, records of said County; easterly by the westerly U.S. Harbor Line of the Kaw River; southerly by a line drawn parallel with and distant southerly 20 feet, measured at right angles, from said southerly line of land described in said deed dated June 30, 1967; westerly by a line drawn parallel with and distant westerly 50 feet, measured at right angles, from said U.S. Harbor Line.

 

All that part of the Chicago, Rock Island and Pacific Railroad right of way lying in Fractional Section 14, Township 11 South, Range 25 East, of the Sixth Principal Meridian in Kansas City, Wyandotte County, Kansas, described as follows: Commencing at a point on the Kansas/Missouri state line 3,179.05 feet south of the northeast corner of said Fractional Section 14, (said point also being the southwest


corner of Section 6, Township 49 North, Range 33 West of the Fifth Principal Meridian, in Kansas City, Jackson County, Missouri); thence South 011'38" West, 854.18 feet, along said state line, to the north right of way line of the Chicago, Rock Island and Pacific Railroad and the true point of beginning of the tract of land to be herein described; thence North 8732'56" West, 98.36 feet along said right of way line, to the United States Harbor Line, which is a non-tangent concave curve to the west and to which point a radial line bears North 8145'22" East; thence southerly along said Harbor Line, on a curve to the right having a radius of 1,910.08 feet, to its intersection with a line drawn 30.0 feet south of and parallel to the north line of said railroad right of way; thence South 8732'56" East along said parallel line to its intersection with the aforesaid Kansas/Missouri state line; thence North 011'38" East along said state line to the true point of beginning.

 

A copy of the lease agreement, which is attached hereto and made a part hereof by reference, is hereby approved for a term of 20 years beginning March 1, 1999, and ending February 28, 2019, with a ten-year option to renew at a rate of $8,800.00 annually, adjusted annually based on Consumer Price Index (CPI), and for the use of one interduct within the conduit for use by Kansas City, Missouri.
