COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 990161

 

Approving a Community Unit Project on an approximately 120.76 acre tract of land generally located on the west side of N. Eastern Avenue (proposed), approximately 2600 feet south of N.E. 108th Street. (12123-CUP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 120.76 acre tract of land generally located on the west side of N. Eastern Avenue (proposed), approximately 2600 feet south of N.E. 108th Street, and more specifically described as follows:

 

A tract of land in the Northeast Quarter of Section 33 and the Northwest Quarter of Section 34, all in Township 52, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Beginning at the southeast corner of said Northeast Quarter; thence North 8949'54" West, along the south line of said Northeast Quarter, 2641.87 feet to the southwest corner of said Northeast Quarter; thence North 023'33" East, along the west line of said Northeast Quarter, 916.80 feet; thence South 8930'36" East, 475.00 feet; thence North 6502'12" East, 936.53 feet to the northeast corner of the Southwest Quarter of said Northeast Quarter; thence North 024'34" East, along the west line of the Northeast Quarter of said Northeast Quarter, 1311.89 feet to the northwest corner of the Northeast Quarter of said Northeast Quarter; thence South 8911'19" East, along the north line of said Northeast Quarter, 1321.73 feet to the northwest corner of said Northwest Quarter; thence South 8930'00" East, along the north line of said Northwest Quarter, 59.1l feet; thence South 1731'17" East, 770.76 feet; thence southerly, along a curve to the right, tangent to the last described course, having a radius of 980.00 feet, an arc distance of 787.17 feet; thence South 2830'03" West, 211.54 feet; thence southerly, along a curve to the left, tangent to the last described course, having a radius of 1100.00 feet, an arc distance of 538.99 feet to a point on the east line of said Northeast Quarter; thence South 025'34" West, along said west line, 408.09 feet to the point of beginning. Containing 120.76 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer make any necessary improvements as required by the City Engineers Office.

 


3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate right of way for N. Eastern Avenue as required by the Department of Public Works so as to provide 40 feet of right of way as measured from the centerline of N. Eastern Avenue.

 

5. That the developer improve the west half of N. Eastern Avenue to secondary arterial street standards as required by the Department of Public Works and further construct N. Eastern Avenue to N.E. 108th Street, if not yet constructed, as required by the Department of Public Works.

 

6. That the developer dedicate additional right of way for N. Reinking Road as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of N. Reinking Road.

 

7. That the developer improve the east half of N. Reinking Road to collector street standards as required by the Department of Public Works.

 

8. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

11. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on City right of way, with a copy to be submitted to the Department of City Development. The plan shall include, size, type, species and placement of trees.

 

12. That the developer submit a street name sign plan to the Street Naming Committee for approval.

 

13. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

14. That the developer contribute $8,798.40 in lieu of parkland dedication for 283 single family lots (283 x 0.006 x 3.7 x $10,729.75 minus 5.46 acres of private open space) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

15. That the developer submit covenants, conditions and restrictions to the Law Department for approval with the final plat for the maintenance of private open space and detention/retention areas.

 

16. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, screening, grading, berming and signage.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 990161, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
