Accepting land being
conveyed by Special Warranty Deed to the City from the State of Missouri,
acting by and through the Missouri Highways and Transportation Commission,
said land generally located west of 1-29 and south of N.W. Barry Road; and
authorizing the City Clerk to file same
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the following described property being conveyed by the State of Missouri acting
through the Missouri Highways and Transportation Commission, to the City of
Kansas City, Missouri, in fee simple and generally located west of I-29 and
south of N.W. Barry Road, is hereby accepted. The legal description is as
follows:
All
rights, title and interest in a tract of land in the Northeast 1/4 Southeast
1/4 of Section 12, Township 51 North, Range 34 West, Kansas City, Platte
County, Missouri, described as follows: Beginning at the northeast corner of
the Southeast 1/4 of said Section 12; thence North 89E5023 West, along the north line of the Southeast 1/4 of said Section
12, a distance of 126.64 feet to a point; thence South 00E0937 West, a distance of 119.17 feet to the true point of beginning;
thence South 07E5522 East, a distance of 612.98 feet, to the
proposed northerly right of way line of relocated Prairie View Road; thence
northwesterly along said relocated right of way line, along a curve to the
left, having a radius of 350.00 feet, an arc length of 130.17 feet, a chord
bearing of North 39E5931 West, to a point; thence North 05E1450 West, a distance of 58.50 feet to the southeast corner of Lot 3
in Barry View Square, a subdivision in Kansas City, Platte County, Missouri;
thence continuing North 05E1450 West, along the easterly
line of Barry View Square, a distance of 54.89 feet to a point; thence North 39E1804 West, along the easterly line of Barry View Square, a distance
of 478.55 feet to a point; thence North 05E3307 West, a
distance of 27.00 feet to a point; thence North 39E1804 West, a distance of 33.97 feet to a point; thence South 85E1016 East, a distance of 337.49 feet to the true point of beginning;
containing 92,989 square feet, more or less, subject to all public roads,
easements, reservations, restrictions, covenants and conditions, if any, now of
record.
Section 2: That
the City Clerk is hereby directed to record a copy of this ordinance in the
office of the Director of Records for Platte County, Missouri, as evidence of
the acceptance of herein described property by the City for public use
purposes.
