COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 031002

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0508, rezoning an area of approximately 25.3 acres generally located on the north side of N.W. Tiffany Springs Road at N. Hull Avenue from Districts GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-5 (Medium Density Residential), and approving a development plan for the same. (9831-GP-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0508, rezoning an area of approximately 25.3 acres generally located on the north side of N.W. Tiffany Springs Road at N. Hull Avenue from Districts GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-5 (Medium Density Residential), said section to read as follows:

 

Section 80-11A0508. That an area legally described as:

 

All that part of the Northeast Quarter of Section 6, Township 51, Range 33, in Kansas City, Platte County, Missouri, described as follows: Beginning at the southeast corner of the Northeast Quarter of said Section 6; thence North 88E52'44" West along the south line of the Northeast Quarter of said Section 6, a distance of 969.49 feet; thence North 1E07'16" East, a distance of 96.00 feet; thence North 24E14'49" East, a distance of 148.66 feet; thence North 14E35'56" West, a distance of 95.64 feet; thence North 31E33'13" West, a distance of 63.62 feet; thence North 43E00'31" East, a distance of 93.68 feet; thence North 24E55'33" East, a distance of 124.48 feet; thence North 16E18'01" West, a distance of 136.05 feet; thence North 56E50'05" East, a distance of 127.79 feet, thence South 63E07'01" East, a distance of 76.04 feet; thence North 44E33'22" East, a distance of 103.94 feet; thence southeasterly on a curve to the left having an initial tangent bearing of South 45E26'38" East and a radius of 325.00 feet, an arc distance of 13.75 feet; thence North 42E07'56" East, a distance of 50.00 feet; thence North 31E45'45" East, a distance of 133.73 feet; thence North 38E31'01" West, a distance of 43.99 feet; thence North 14E02'30" East, a distance of 132.74 feet; thence North 36E30'18" East, a distance of 86.17 feet; thence North 33E33'08" East, a distance of 85.42 feet; thence North 27E26'17" East, a distance of 85.21 feet; thence North 24E49'04" East, a distance of 85.97 feet; thence North 19E30'30" East, a distance of 89.93 feet; thence North 0E14'34" West, a distance of 158.32 feet; thence South 89E34'31" East, a distance of 327.93 feet to the east line of the Northeast Quarter of said Section 6; thence South 0E25'29" West along the east line of the Northeast Quarter of said Section 6, a distance of 1658.59 to the point of beginning. Said tract of land contains 25.33 acres more or less.

 


is hereby rezoned from Districts GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-5 (Medium Density Residential), all as shown outlined on a map marked Section 80-11A0508, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit an overall storm drainage study to the City Engineers Office for approval for the entire development at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer dedicate additional right of way for N.W. Tiffany Springs Road as required by the Department of Public Works so as to provide 46 feet of right of way as measured from the centerline of N.W. Tiffany Springs Road.

 

4. That the developer construct an eastbound left turn lane on N.W. Tiffany Springs Road at N. Hull Avenue with storage of 150 feet in length and proper tapers as required by the Department of Public Works.

 

5. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb and gutter, storm sewers, streetlights, sidewalks, grade modifications resulting in reconstruction of existing road section to meet vertical and horizontal alignment standards, and private utility relocations to outside the right-of-way.

 

6. That the developer provide adequate intersection sight distance at all proposed subdivision entrances from N.W. Tiffany Springs Road as required by the Department of Public Works.

 

7. That the developer secure permits or performance bonds to construct sidewalks along the frontage of all homeowner association tracts (pools, tracts, etc.) and all double-fronted lots prior to recording of a final plat containing any of the aforementioned parcels.

 

8. That the developer make an application to the City to vacate the north-south section of former N.W. Tiffany Springs Road adjacent to Phase 6 as shown on the preliminary plan prior to submittal of the plat of Phase 6.

 

9. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

10. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

11. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area of the entire development exceeds one acre.

 

12. That the developer contribute $61,500.87 in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations. Calculation based on: [(360 lots X 3.7 persons per single-family unit) X 0.006 acres per person] = 7.99 acres of open space provided, minus 2.59 acres provided = 5.4 acres deficient X $11,389.05 = $61,500.87.

 

13. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities in the floodplain.

 

14. That the developer extend sanitary and storm sewers and determine adequacy as required by the Department of Public Works and Water Services Department.

 

15. That the developer extend or enlarge water mains and provide easements as required by the Water Services Department.

 

16. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

17. That the developer grant a Noise and Aviation Easement to the City.

 

18. That the developer comply with the Kansas City International Airport height regulations as required by the City.

 

19. That the developer submit a street tree planting plan as part of all final plats and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the Department of City Development. The plan shall include size, type, species and placement of trees. The developer shall agree to plant in accordance with the plan approved by the City Forester.

 

20. That the developer submit a final plan to the City Plan Commission for approval of all proposed community facilities including the pool and clubhouse, monument signs and walking trails (if any); the final plans shall include detailed information on grading, landscaping, fencing, lighting, signage (including elevations), and building elevations (with material palette).

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 031002, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
