ORDINANCE NO. 150470

 

Repealing and reenacting various provisions of Chapter 2, Chapter 70, and Chapter 74 of the Code of Ordinances to clarify the City Auditor’s responsibilities and to amend the bond requirements of certain city officials.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 2-204 Distribution of payroll warrants and Section 2-1646 relating to Bonds of city officials and enacting in lieu thereof two new sections of like number and subject, to read as follows:

 

Sec. 2-204. Distribution of payroll warrants.

 

Payroll warrants shall be delivered or distributed to all officers or employees of the city by or at the direction of the heads of the respective departments or offices who shall periodically verify the validity and accuracy of the payroll. The Director of Finance is authorized to choose any form(s) of a payroll warrant and distribution or delivery method that is authorized by law and all City Memorandums of Understanding.

 

Sec. 2-1646. Bonds of city officials.

 

(a)    Bond shall be given to the city for the faithful performance of his or her duties, and the correct accounting for and delivery to the city of all moneys or other property in his or her custody and belonging to or under control of the city, by each and every officer or employee indicated in the following list and enumeration, for the amount set opposite his or her proper designation:

 

Director of finance

$1,000,000.00

 

 

City treasurer

1,000,000.00

 

 

Each officer or other employee whose duties include the receiving, custody or disbursement of money or other property in such sums or of such values as the director of finance may require, not to exceed

500,000.00

 

(b) All such official bonds shall be given upon the security of a reliable surety company duly authorized to do business in the state and empowered by law to sign surety or give bonds for the faithful discharge of duty by public officers and others.

 

(c)The premium on all such official bonds shall be paid by the city from appropriation made to the respective offices.

 

Section 2. That Chapter 70, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 70-176 relating to illegal cancellation of traffic tickets and audit of ticket records and Section 70-645 relating to receipt for payment of impoundment charges; records of collections; and enacting in lieu thereof two new sections of like number and subjects, to read as follows:

 

Sec. 70-176. Illegal cancellation of traffic ticket; city auditor access to ticket records.

 

(a) It shall be unlawful for any person to cancel or solicit the cancellation of any traffic ticket, in any manner other than as provided in this chapter.

 

(b) The city auditor or his duly authorized representative shall have access at all times to the necessary records, files and papers of the court and its violations bureau and the police department.

 

Sec. 70-645. Receipt for payment of impoundment charges; records of collections.

 

In accepting payment for removal and storage charges as provided in this article, after proof of ownership and before the sale, the person applying for the motor vehicle shall be given a printed receipt showing the amount paid and the amount waived, if any which amounts shall at the same time automatically be recorded. The collections received at the city impound lot each day shall be paid to the city treasurer in accordance with Section 2-1615.

 

Section 3. That Chapter 74, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 74-83 relating to budgets and audits and enacting in lieu thereof one new section of like number and subject, to read as follows:

 

Sec. 74-83. Budgets and audits.

 

The land bank agency shall prepare an annual budget, and the board shall review and approve a budget for the land bank agency proceeding each fiscal year, which will correspond to the fiscal year of the city. Accounts shall be established and disbursements of funds shall be in accordance with guidelines established by the board, consistent with the recommendations of the city's finance department. While under no obligation to do so, the city may contribute to the annual budget in such manner as approved by the city. Such contribution or the incurring of expenses by the city on behalf of the land bank agency, shall be reimbursed to the city from sale proceeds consistent with subsections 74-81(a)(3) and 74-81(b)(4). There shall be an annual audit of the affairs, accounts, expenses, and financial transactions of a land bank agency by certified public accountants as of April thirtieth of each year, which accountants shall be employed by the commissioners on or before March first of each year, and certified copies thereof shall be furnished to the appointing authorities described in section 74-73, and shall be available for public inspection at the office of the land bank agency. The cost of such audit shall be paid by the land bank agency, and copies shall be made available to the public within 30 days of the completion of the audit. In addition to the annual audit provided for in this subdivision, the state auditor and city auditor may conduct audits of the land bank agency at any time.
