ORDINANCE NO. 130162

 

Rezoning a 0.4 acre tract of land, generally located at the northwest corner of 85th Street and Holmes Road, from Districts B3-2 and R-6 to District B3-2, and setting building permit conditions. (14367-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0929, rezoning an area of approximately 0.4 acre tract of land, generally located at the northwest corner of 85th Street and Holmes Road, from Districts B3-2 (Community Business dash 2) and R-6 (Residential dash 6) to District B3-2 (Community Business dash 2), said section to read as follows:

 

Section 88-20A0929. That an area legally described as:

 

8430 HOLMES RD – SEC-20 TWP-48 RNG -33 BEG AT SE COR OF NW ¼ OF NE ¼ OF SEC 20-48-33 TH N ALG E LI OF SD ¼ - ¼ SEC 208.7’ TH W & PARA WI S LI OF SD ¼ - ¼ , 308.84’ TH S & PARA WI SD E LI OF SD ¼ - ¼ SEC 208.7’ TO S LI OF ¼ - ¼ SEC TH E TO POB (EX STS & EX PT PLAT HOLMES VIEW & EX W 150.84’) 20-48-33.

 

is hereby rezoned from Districts B3-2 (Community Business dash 2) and R-6 (Residential dash 6) to District B3-2 (Community Business dash 2), all as shown outlined on a map marked Section 88-20A0929, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That any building permit issued for the area legally described above is subject to the following conditions:

 

1.                  That the surface of the parking area and all access drive shall be improved with a compacted macadam base, not less than 4” thick, and surface with asphaltic concrete or some other comparable all-weather, dustless material.

 

2.                  That the periphery of the parking area shall be provided with a fence, wall or landscaping plantings sufficiently thick to serve the purpose of a solid screen, and of a height sufficient to obscure the parking area from any adjoining residentially-zoned property, or residentially-zoned property lying across the street from said parking area.

 

3.                  That any lighting fixtures must be directed away from the surrounding residential properties and must illuminate only the surface of the parking area.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
