SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 020190

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0403, rezoning an area of approximately 6.22 acres generally located at the northeast corner of 139th Street and the prolongation of Horridge Road from District GPA (General Planned Development District, Agricultural) to District GPR-1 (General Planned Development District, Residential, Low Density), and approving a development plan for the same. (12664-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0403, rezoning an area of approximately 6.22 acres generally located at the northeast corner of 139th Street and the prolongation of Horridge Road from District GPA (General Planned Development District, Agricultural) to District GPR-1 (General Planned Development District, Residential, Low Density), said section to read as follows:

 

Section 80-11A0403. That an area legally described as:

 

A tract of land in the Southwest Quarter of Section 23, Township 47, Range 32, Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the southwest corner of said Southwest Quarter; thence North 02E36'17" East along the west line of said Southwest Quarter, a distance of 180.01 feet to a point on the City limits line of Kansas City and Lees Summit; thence South 88E05'56" East along said City limits line, a distance of 1505.03 feet to a point on the westerly line of Tract A, Monarch View 1st Plat, a subdivision in Lees Summit, Jackson County, Missouri; thence South 02E38'15" West, along said tract, a distance of 180.01 feet to a point on the south line of said Southwest Quarter; thence North 88E05'56" West along said south line, a distance of 1504.93 feet to the point of beginning. Containing 6.22 acres, more or less, except that portion in streets and roads.

 

is hereby rezoned from District GPA (General Planned Development District, Agricultural) to District GPR-1 (General Planned Development District, Residential, Low Density), all as shown outlined on a map marked Section 80-11A0403, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 


2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend sanitary and storm sewers as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department or receive approval from the City through an agreement with the Water Services Department to access water from the City of Lees Summit.

 

9. That the developer dedicate additional right of way for 139th Street as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of 139th Street.

 

10. That the developer improve the north half of 139th Street to collector street standards as required by the Department of Public Works, including construction of sidewalks.

 

11. That the developer dedicate right of way for View High Drive as required by the Department of Public Works so as to provide a total of 60 feet of right of way as measured from the centerline of View High Drive.

 

12. That the developer enter into an unsecured deferral agreement with the City whereby the developer agrees to contribute $134.00 per front foot for the improvement of View High Drive at such time as View High Drive is improved to the north as required by the Department of Public Works.

 

13. That the developer secure the approval of the Board of Zoning Adjustment for any residential identification signs.

 

14. That a variance is hereby granted to the minimum lot depth of 160 feet required pursuant to Section 66-122(c)(1), Code of Ordinances, for Lots 255 through 265 as shown on the preliminary plat.

 

15. That the developer submit a final plan to the City Plan Commission for approval for the residential identification signs and grading and landscaping on that portion of the detention tract within Kansas City, Missouri.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 020190, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
