ORDINANCE NO. 060672

 

Authorizing an amendment to a lease with Cingular for cellular equipment located at approximately 27th and Van Brunt.

 

WHEREAS, the City of Kansas City Missouri Landlord and New Cingular Wireless PCS, LLC, successor in interest to Kansas City SMSA Limited Partnership (Tenant) are parties to a lease agreement dated January 11, 1991 (the Lease), whereby Tenant leases from Landlord certain space on real property commonly known as 27th and Van Brunt, Kansas City, Missouri (the Leased Property), which is more particularly described in the Lease, upon which Tenant owns, operates and maintains a telecommunications facility; and

 

WHEREAS, the parties agree to modify certain terms and conditions of the Lease; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of City Development is authorized to enter into an Amendment to a Lease which would allow the tenant to install additional equipment and update existing equipment at that location; allow the City of Kansas City to collect rent in the amount of $1,250.00 monthly for the first term of the agreement; and allow an option to renew the agreement for an additional five year term beginning January 12, 2011 at the rental rate of $1,437.50 per month.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
