Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 17 acre tract of land generally located at the southwest corner of U.S. Highway 40 and Lee's Summit Road. (9789-P-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 17 acre tract of land generally located at the southwest corner of U.S. Highway 40 and Lee's Summit Road, and more specifically described as follows:

 

Part of the East One-Half (E ) of the Southeast One-Quarter (SE 1/4) of Section 25, Township 49, Range 32, including all of Milton Acres, all being in Kansas City, Jackson County, Missouri: Commencing at the southwest corner of the East One-Half (E ) of the Southeast One-Quarter (SE 1/4) of Section 25, Township 49, Range 32, thence North 01 57'07" East on the west line, East One-Half (E ), Southeast One-Quarter (SE 1/4), Section 25-49-32, 2127.00 feet to a point; thence South 87 10'05" East, 165.00 feet to the true point of beginning; thence North 01 57'07" East, 472.59 feet to a point on the existing southerly right of way line of U.S. Highway No. 40; thence South 86 57'13" East on the existing southerly right of way line of U.S. Highway No. 40, 141.09 feet to a point of curvature; thence continuing easterly on the existing southerly right of way line of U.S. Highway No. 40 on a curve to the right having a radius of 5674.58 feet, a distance of 293.82 feet to a point of tangency; thence continuing on said existing southerly right of way line, South 84 13'20" East, 104.60 feet to a point; thence continuing on said existing southerly right of way line, South 61 26'25" East, 108.46 feet to a point; thence continuing on said existing southerly right of way line, South 84 13'20" East, 25.00 feet to a point; thence continuing on said existing southerly right of way line, North 66 31'45" East, 85.96 feet to a point; thence continuing on said existing southerly right of way line, South 84 13'20" East, 260.00 feet to a point; thence continuing on said existing southerly right of way line, South 63 42'57" East, 53.38 feet to a point of curvature; thence southeasterly and southerly on the existing westerly right of way line of Lee's Summit Road on a curve to the right having a radius of 86.08 feet, 58.09 feet to a point of tangency, said point also being on the westerly dedicated right of way line of Lee's Summit Road, as now established; thence continuing on said existing westerly right of way line, South 01 51'27" West, 283.79 feet to a point; thence continuing on said existing westerly right of way line, South 03 50'59" East, 320 feet to a point; thence North 87 03'17" West, 1046.72 feet to a point; thence North 43 02'53" West, 75.10 feet to a point; thence North 01 57'07" East, 200.00 feet to the true point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer dedicate additional right of way for Lee's Summit Road as required by the Department of Public Works so as to provide a total of 40 feet of

right of way as measured from the centerline of Lee's Summit Road.

 

6. That the developer improve the west side of Lee's Summit Road to secondary arterial street standards as required by the Department of Public Works.

 

7. That the developer dedicate additional right of way for U.S. Highway 40 as required by the Department of Public Works so as to provide a total of 55 feet of right of way

as measured from the centerline of U.S. Highway 40.

 

8. That the developer improve the south side of U.S. Highway 40 to primary arterial street standards as required by the Department of Public Works.

 

9. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 961463, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
