ORDINANCE NO. 990383

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0205, rezoning an area of approximately 1.95 acres generally located at the southwest corner of Independence Boulevard and Prospect Avenue from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0205, rezoning an area of approximately 1.95 acres generally located at the southwest corner of Independence Boulevard and Prospect Avenue from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District C-2-p (Local Retail Business - Limited District), said section to read as follows:

 

Section 80-11A0205. That an area legally described as:

 

All that tract of land in the Northeast 1/4 of Section 4, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the intersection of the south line of Independence Boulevard and the west line of Prospect Avenue, as said boulevard and avenue are presently established; thence South 029'52" East along said west line of said Prospect Avenue, a distance of 325.22 feet to the intersection of said westerly line with the north line of 6th Street, as presently established; thence South 8922'04" West along said north line of 6th Street, a distance of 277.00 feet; thence North 029'46" West, a distance of 208.28 feet to a point on the westerly prolongation of the south line of a tract of land described in a Quit Claim Deed recorded as Document No. K-1197804 in Book K-2704 at page 103; thence North 9000'00" East along said westerly prolongation and along the south line of the last said tract of land, a distance of 46.00 feet to the southeast corner thereof; thence North 029'52" West along the east line of the last said tract of land, a distance of 120.00 feet to the northeast corner thereof, said point being on the south line of said Independence Boulevard; thence North 9000'00" East along said south line of Independence Boulevard, a distance of 231.00 feet to the point of beginning. Containing 84,988 square feet or 1.951 acres, more or less.

 

is hereby rezoned from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 80-11A0205, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 


1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for Prospect Avenue as required by the Department of Public Works so as to provide 40 feet of right of way as measured from the centerline of Prospect Avenue.

 

5. That the developer improve the west half of Prospect Avenue to secondary arterial street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

6. That the developer improve the south half of Independence Boulevard to parkway standards as required by the Board of Parks and Recreation Commissioners, including construction of curb, gutter and sidewalks, installation of streetlights and replacement of any disturbed streetscape features.

 

7. That the developer reconstruct the sidewalks on 6th Street as required by the Department of Public Works.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer relocate fire hydrants as required by the Fire Department and the Water Services Department.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, signage (including elevations), grading and building elevations.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 990383, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
