ORDINANCE NO. 041004

 

Amending Ordinance No. 991310 by repealing Section 2 and enacting in its place a new section, correcting the legal description of Project Area 3 of the Prospect North Tax Increment Financing Plan.

 

WHEREAS, the City Council of Kansas City, Missouri by Ordinance No. 54556 passed on November 24, 1982 and thereafter repealed and amended in certain respects by Committee Substitute to Ordinance No. 911076, as amended, passed on August 29, 1991, created the Tax Increment Financing Commission of Kansas City, Missouri (the "Commission"); and

 

WHEREAS, on March 23, 2000, the City Council passed Committee Substitute for Ordinance No. 991307, As Amended, which approved the Prospect North Tax Increment Financing Plan ("Redevelopment Plan") and designated the Redevelopment Area as a blighted area and later amended the Redevelopment Plan by passage of Ordinance No. 031191 and Ordinance No. 04____, correcting the legal description of the Plan Area; and

 

WHEREAS, the Redevelopment Plan and ordinance contemplate the implementation of the Redevelopment Plan through a number of separate Redevelopment Projects and the adoption of tax increment financing in each of the areas selected for such Redevelopment Projects; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 991310 is hereby amended by repealing Section 2 and enacting in its place a new section to read as follows:

 

Section 2. The area selected for Redevelopment Project Area 3 legally described as follows:

 

All that part of the Southwest Quarter of Section 7, Township 51, Range 32, Kansas City, Clay County, Missouri, described as follows:  Commencing at the Southeast corner of the Southwest Quarter of said Section 7; thence North 00 degrees 38 minutes 47 seconds East along the East line of the Southwest Quarter of said Section 7, a distance of 83.70 feet; thence North 89 degrees 21 minutes 13 seconds West, a distance of 210.00 feet to the Point of Beginning of the tract of land herein to be described, said point also being on the Westerly right-of-way line of Missouri State Route M-1 and on the Northerly right-of-way line of Maplewoods Parkway; thence North 88 degrees 44 minutes 33 seconds West along the Northerly right-of-way line of said Maplewoods Parkway, a distance of 204.14 feet; thence continuing along said right-of-way line Easterly along a curve to the right being tangent to the last described course having a radius of 1425.00 feet, an arc distance of 544.14 feet; thence continuing along said right-of-way line North 66 degrees 51 minutes 51 seconds West, a distance of 300.85 feet to the Easterly right-of-way line of North


Agnes Avenue; thence North 13 degrees 36 minutes 03 seconds East along said right-of-way line, a distance of 77.62 feet; thence continuing along said right-of-way line Northerly along a curve to the left being tangent to the last described course having a radius of 830.00 feet, an arc distance of 319.07 feet; thence continuing along said right-of-way line North 08 degrees 25 minutes 29 seconds West, a distance of 230.14 feet; thence continuing along said right-of-way line Northerly along a curve to the right being tangent to the last described course having a radius of 770.00 feet, an arc distance of 113.22 feet; thence continuing along said right-of-way line North 00 degrees 00 minutes 00 seconds East, a distance of 187.34 feet to the Southerly right-of-way line of Northeast 82nd Street; thence South 89 degrees 07 minutes 32 seconds East, a distance of 605.18 feet; thence North 00 degrees 34 minutes 46 seconds East, a distance of 5.00 feet; thence continuing along said right-of-way line South 89 degrees 07 minutes 32 seconds East, a distance of 331.63 feet to the Westerly right-of-way line of said Missouri State Route M-1; thence South 0 degrees 52 minutes 28 seconds West along said right-of-way line, a distance of 29.95 feet; thence continuing along said right-of-way line South 89 degrees 07 minutes 49 seconds East, a distance of 54.99 feet; thence continuing along said right-of-way line South 43 degrees 14 minutes 49 seconds East, a distance of 76.35 feet; thence continuing along said right-of-way line South 01 degrees 35 minutes 35 seconds West, a distance of 774.26 feet; thence continuing along said right-of-way line South 00 degrees 38 minutes 47 seconds West, a distance of 287.34 feet to the Point of Beginning. Said tract of land contains 24.90 acres more or less.
