COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090822

 

Authorizing the Director of Public Works to enter into various Chouteau Agreements; reducing funds in the amount of $5,258,650.60 and appropriating this sum to the Chouteau Parkway Project; reducing funds in the amount of $69,763.05 and appropriating this sum to the Chouteau Parkway Project; reducing funds in the amount of $1,800,000.00; estimating and appropriating revenue in the amount of $1,800,000.00; allocating future funds of $7,983,012.00 to the projects; and designating requisitioning authority.

 

WHEREAS, the City of Kansas City, Missouri (City) and the Missouri Highway and Transportation Commission (Commission) executed a Memorandum of Understanding (MOU) that established conditions that would lead to the Chouteau Bridge being taken into the state highway system so that state transportation funds could be used to complete the construction of the bridge project approved by City Council on November 19, 1998 with Ordinance 981331; and

 

WHEREAS, the City and the Commission wish to fulfill part of the conditions set forth in the MOU at this time by transferring Chouteau Trafficway, including the bridge, between Interstate 35 and Front Street and North Oak Trafficway from Vivion Road to Northeast 32nd Street; and

 

WHEREAS, the City and the Commission agree to continue to pursue the remaining conditions of the MOU over a period of time which includes the transfer of Front Street from Interstate 35/29 to Interstate 435 and Bannister Road from the state line to east of Interstate 435; and

 

WHEREAS, the Commission wishes to take ownership and accept maintenance of Chouteau Trafficway between Route 210 and Front Street, and make improvements to the Chouteau Bridge over the Missouri River which include crack repairs and new bicycle/pedestrian improvements; and

 

WHEREAS, the City wishes to take ownership and accept maintenance of Chouteau Trafficway between Interstate 35 and Highway 210; and

 

WHEREAS, the Kansas City Board of Parks and Recreation Commissioners (Park Board) has included Chouteau Trafficway in their Centennial Boulevard and agrees to cause improvements to Chouteau Trafficway between Interstate 35 and Highway 210 that includes a four-lane facility with limited access that improves traffic capacity and safety and is designed to accommodate large trucks at minimum speed limits of forty miles per hour and the Commission agrees to contribute $20,000,000.00 toward the improvement; and

 


WHEREAS, the City wishes to take ownership and accept maintenance of North Oak Trafficway from Vivion Road to Northeast 32nd Street; and

 

WHEREAS, the Commission wishes to make improvements to the Front Street Interchange at Interstate 435 and the City is willing to participate in the cost of right-of-way and the City wishes to develop right-of-way plans and documents for Front Street between Interstate 35/29 to Interstate 435 in accordance with the MOU; and

 

WHEREAS, Project 89008088, Chouteau/Front Street ROW, the remaining funds are being moved to 70400001, Chouteau Parkway, to complete the Parkway project; and

 

WHEREAS, Project 89005532, Chouteau Bridge Repairs, the remaining funds are being moved with 70400001, Chouteau Parkway, to the Parkway project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to enter into a Chouteau Cost Apportionment/Road Relinquishment Agreement, a Chouteau Roadway Maintenance/Relinquishment Agreement, and a I-435 & Front Street Municipal Agreement all with the Missouri Highway and Transportation Commission (MHTC) for the purposes of transferring ownership and maintenance of the Chouteau Bridge over the Missouri River to the Missouri Highway and Transportation Department. Copies of the agreements are on file in substantial form in the Public Works Directors Office.

 

Section 2. That the appropriations in the following accounts of the Capital Improvements Fund are reduced by the following amounts:

 

10-3090-898011-B-89008088 Chouteau / Front Street ROW $2,933,994.24

10-3090-898011-E-89008088 Chouteau / Front Street ROW 825,000.00

10-3090-898031-A-89005532 Chouteau Bridge Repairs 149,656.36

10-3090-898031-B-89005532 Chouteau Bridge Repairs 1,350,000.00

TOTAL $5,258,650.60

 

Section 3. That $1,800,000.00 is appropriated from the Unappropriated Fund Balance of the General Debt and Interest Fund to the following account:

 

10-5010-129998-X-903090 Transfer to Capital Improvement Fund $1,800,000.00

 

Section 4. That revenue in the amount of $1,800,000.00 is estimated in the following account of the Capital Improvements Fund:

 

10-3090-120000-505010 Transfer from General Debt and $1,800,000.00

Interest Fund

 


Section 5. That the sum of $7,058,650.60 is appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account in the Capital Improvements Fund:

 

10-3090-708011-B-70400001 Chouteau Parkway $7,058,650.60

 

Section 6. That the appropriation in the following account of the GO Bond Fund - 2004F is reduced by the following amount:

 

AL-3391-897184-B-89005532 Chouteau Bridge Repairs $69,763.05

 

Section 7. That the sum of $69,763.05 is hereby appropriated from the Unappropriated Fund Balance of the GO Bond Fund-2004F to the following account in the GO Bond Fund-2004F:

 

AL-3391-708011-B-70400001 Chouteau Parkway $69,763.05

 

Section 8. That the Public Improvements Advisory Committee shall include funds in the 5-year C.I.P. as needed:

 

$7,133,012.00 Chouteau Parkway, Project 70400001

$850,000.00 Front Street I435 to Universal, Project 89008088

 

Section 9. That the Director of Parks and Recreation is designated as requisitioning authority for Account Nos. 3090-708011-70400001 and 3391-708011-70400001.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
