RESOLUTION NO. 110434

Amending the 2010 One Year Action Plan and authorizing submission of a Substantial Amendment to the U.S. Department of Housing and Urban Development for its consideration in order to reallocate funding from one proposed activity to a new activity.

WHEREAS, on March 11, 2010, Council approved the City’s One Year Action Plan through Committee Substitute for Resolution No. 100145 and authorized the submission of said Plan to the U.S. Department of Housing and Urban Development (HUD); and

WHEREAS, the submitted Plan was prepared pursuant to and in accordance with Title I of the National Affordable Housing Act of 1990, as amended, as well as the appropriate administrative rules and regulations promulgated and adopted under such Act; and

WHEREAS, the City now desires at the request of the grant subrecipient to revise the Plan in order to delete funding for a proposed project and redirect this funding to another housing activity; and

WHEREAS, in order to implement this funding reallocation, the City must amend the One Year Action Plan; NOW, THEREFORE;

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Substantial Amendment Number 3 to the 2010 One Year Action Plan prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Substantial Amendment Number 3 to the United States Department of Housing and Urban Development.

Section 3. That the City Council hereby certifies that said Plan has been prepared and submitted to the U.S. Department of Housing and Urban Development pursuant to and in accordance with the Department’s rules and regulations, including but not limited to Title 24, Sections 570.301, through and including, 570.306 of the Code of Federal Regulations.
