RESOLUTION NO. 031327

 

Approving an amendment to the Town Fork Creek Area Plan by modifying the Land Use Plan and Map in an area generally located on the east side of Prospect Avenue from 59th Street to Bruce R. Watkins Drive to be consistent with the Blue Hills Neighborhood Plan. (227-S-9)

 

WHEREAS, on March 10, 1978, the City Council by Resolution No. 48787 adopted the Town Fork Creek Area Plan as a guide for development and redevelopment of that area generally located between Blue Parkway and 63rd Street and between Prospect and the Big Blue River; and

 

WHEREAS, said Town Fork Creek Area Plan was amended on November 30, 1989, through the adoption of Resolution No. 64741; was amended on March 26, 1992, through the adoption of Resolution No. 920131; was amended on June 30, 1994, through the adoption of Resolution No. 940642; was amended on December 20, 2001, through the adoption of Resolution No. 011677; was amended on June 6, 2002, through the adoption of Resolution No. 020585; and was further amended on November 7, 2002, through the adoption of Resolution No. 021246; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Town Fork Creek Area Plan as it affects that area generally located on the east side of Prospect Avenue from 59th Street on the south to Bruce R. Watkins Drive on the north, by modifying the Proposed Land Use Plan and Map for such area from medium density residential (9-28 units per acre) uses with commercial uses between 62nd Street and 63rd Street, 58th Street and 60th Street and north of 53rd Street all to medium density residential uses with mixed-use nodes at 59th Street and 55th Street; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on November 3, 2003; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on November 18, 2003; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on November 18, 2003, recommend approval of the proposed amendment to the Town Fork Creek Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the seventh amendment to the Town Fork Creek Area Plan is hereby approved for that area generally located on the east side of Prospect Avenue from 59th Street on the south to Bruce R. Watkins Drive on the north, by modifying the Proposed Land Use Plan and Map for such area from medium density residential uses with commercial uses between 62nd Street and 63rd Street, 58th Street and 60th Street and north of 53rd Street all to medium density residential uses with mixed-use nodes at 59th Street and 55th Street. A copy of the amendment to the Land Use Plan and Map of the Town Fork Creek Area Plan is attached hereto as Exhibit A and incorporated


herein by reference.

 

Section B. That the amendment to the Town Fork Creek Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute 021246 for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
