ORDINANCE NO. 010159

 

Accepting a Quit Claim Deed from the County of Jackson County, Missouri, conveying land to the City for public use purposes in connection with the Longview Road widening project; devoting certain portions of parcels for street right-of-way, permanent drainage easements and permanent retaining wall easements; and directing the City Clerk to file certain documents with the appropriate offices.

 

WHEREAS, the County of Jackson County, Missouri, acquired certain portions of parcels of land for the widening of Longview Road from Orchard Road to Blue Ridge Boulevard under the County Urban System Program; and

 

WHEREAS, the parcels had not previously been conveyed to the City of Kansas City, Missouri; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Quit Claim Deed dated December 18, 2000, from the County of Jackson County, Missouri to Kansas City, Missouri and recorded as Document No. 2001K0000491 containing 17 pages, in the office of the Director of Records of Jackson County, Missouri at Independence, is hereby accepted, said deed conveys the following described property as shown on the attached Exhibit A, pages 1 through 15.

 

Section 2. That those portions of tracts described on Exhibit A as permanent drainage easements and permanent wall easements shall be devoted to such.

 

Section 3. That devoting those portions thereof of tracts described as right-of-way on Exhibit A, pages 1 through 15, as right-of-way for public street purposes as part of the Longview Road, Orchard Road to Blue Ridge Boulevard widening project.

 

Section 4. Accepting TR 35, Total Take, as shown on page 6 of the attached Exhibit A and described as:

 

All of Lot 6, Resurvey of Lots 20, 21, 22, 23, Block 6, Kings Hickman Orchards, in the City of Kansas City, Jackson County, Missouri, according to the recorded plat thereof; subject, however, to all easements; to all rights-of-way for public thoroughfares, to all recorded restrictions, homes association declarations, community contracts, covenants and reservations affecting title to said real property, to all encroachments, if any, to all applicable zoning laws, and to all general taxes and special assessments which are a lien upon said real property.

 

And also devoting a portion thereof of TR 35 as right-of-way for public street purposes as part of the Longview Road, Orchard to Blue Ridge Boulevard widening project, said portion being legally described as follows:


All that part of Lot 6, Resurvey of Lots 20, 21, 22 and 23, Block 6, Kings Hickman Orchards, a subdivision in Kansas City, Jackson County, Missouri, except that part described as follows: Beginning at the southwest corner of said Lot 6; thence in an easterly and northeasterly direction along the southerly line of said Lot 6; along a curve to the left having a radius of 218.43 feet, an arc distance of 96.70 feet; thence North 84E45'43" West, a distance of 58.27 feet; thence North 86E01'11" West, a distance of 35.34 feet to a point on the west line of said Lot 6; thence South 3E21'04" west, along said west line, a distance of 23.36 feet to the point of beginning. Containing 1457 square feet, more or less.

 

The bearings in this description refer to the south line of the Southwest 1/4 of Section 1, Township 47, Range 33, as having a bearing South 84E59'25" East.

 

Section 5. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause said ordinance to be recorded in the office of the Director of Records for Jackson County, Missouri, as evidence of the acceptance of said lands.
