ORDINANCE NO. 200773

 

Authorizing sale of .903 acre tract generally located at 4114 E. 7th Street for the consideration of $20,000.00 that was removed from the City's park system pursuant to an election held on November 5, 2019; and directing the City Clerk to record this Ordinance with the Office of the Recorder of Deeds of Jackson County, Missouri.

 

WHEREAS, on May 7, 2019 the Board of Parks and Recreation Commissioners passed Resolution No. 31242, determining that the .903 acre tract generally located at 4114 E. 7th Street, was no longer necessary or appropriate for park, parkway, or boulevard use, and that such property could be removed from the park system by a vote of the people; and

 

WHEREAS, on June 6, 2019, the City Council passed Ordinance No. 190379 which authorized an election to be held to approve the removal of such .903 acre tract by a vote of the people; and

 

WHEREAS, the election was held on November 5, 2019, and the voters approved removing the tract from the park system; and

 

WHEREAS, the City solicited bids for the purchase of the surplus property; and

 

WHEREAS, the City received only one bid of $20,000.00 from the Lykins Neighborhood Association for the surplus property which met the advertised minimum bid of $20,000.00; and

 

WHEREAS, the .903 acre tract is within the Lykins Neighborhood; and

 

WHEREAS, the Lykins Neighborhood Association had studies performed looking at solutions to provide safe and affordable housing in the area around Lykins Square Park and their residential plan is in line with recommendations in the Lykins Studies; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Parks and Recreation Department is authorized to execute a Special Warranty Deed and any and all other real estate and closing documents necessary to convey the City owned parcel to Lykins Neighborhood Association, LLC, legally described as:

 

All that part of 4114 E. 7th Street. 4114 E. 7th Street/Lykins Community Center Detroit Place, Lots 27 thru 32 Cont, containing .903 acres, more or less, being in Kansas City, Jackson County, Missouri.

 

in consideration for the payment of $20,000.00.

 


Section 2. That the City Clerk is directed to record with the Jackson County, Missouri Recorder of Deeds a certified copy of this ordinance.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
