COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190065

 

Rezoning an area of approximately 2.68 acres generally located at 8030 Ward Parkway Plaza from District R-6 to District B1-1, to expand an existing school building in order to operate a private school and adult care facility for individuals with autism. (CD-CPC-2018-00169)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1185, rezoning an area of approximately 2.68 acres generally located at 8030 Ward Parkway Plaza from District R-6 (Residential 6) to District B1-1 (Neighborhood Business 1 dash 1), said section to read as follows:

 

Section 88-20A1185. That an area legally described as:

 

Home Gardens S 1/2 Lot 11 & all Lots 12 thru 16.

 

is hereby rezoned from District R-6 (Residential 6) to District B1-1 (Neighborhood Business 1 dash 1), all as shown outlined on a map marked Section 88-20A1185, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That a digital copy of the plans, revised as noted below, be submitted to Development Management staff (15th Floor, City Hall), prior to issuance of building permits:

 

a.                   Brick should wrap from north facade to east facade higher than at wainscot.

 

b.                  The northeast corner of the building shall include brick in order to create consistency in the facade design.

 

c.                   Adequate indoor bike parking shall be shown on construction drawings.

 

d.                  If at any time sidewalks are installed on adjoining properties, Sherwood Autism Center will build sidewalk connections at that time.

 

2.                  The developer shall verify fire flow capacity.

 

3.                  The developer shall connect water service lines to the 12" DIP along Ward Parkway Plaza.

 

4.                  Developer shall comply with the KC Water Rules and Regulations for water service lines as found at https://www.kcwaterservices.org/wp-content/uploads/2018/07/2018-Rules-and-Regulations-for-Water-Service-L ines.pdf.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
