Approving the preliminary plat of
Farview Extension on a 7.9 acre tract of land generally located east of N. Garfield Avenue from the North Kansas City, Missouri city limit to 34th Terrace and on N. Garfield Avenue at 33rd Terrace and 34th Terrace. (SD 1189)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Farview Extension on a 7.9 acre tract of land generally
located east of N. Garfield Avenue from the North Kansas City, Missouri city limit to 34th Terrace and on N. Garfield Avenue at 33rd Terrace and 34th
Terrace, and more specifically described as follows:
All that part of the Southeast Quarter of Section 12,
Township 50, Range 33, including Block 15, FARVIEW, a subdivision of land, all
in Kansas City, Clay County, Missouri, described as follows: Beginning at the
Southwest corner of the Southeast Quarter of the Southeast Quarter of said
Section 12, being the Southwest corner of a tract of land Condemned by the City
of Kansas City, Missouri for Park and Recreation purposes and as described in
Ordinance of Kansas City, Missouri, Number 21676, Passed July 5, 1957; thence
North 0000'00" West, along the West line of said Quarter Quarter Section
and the West line of said tract of land, a distance of 130.00 feet; thence
North 4408'07" East, continuing along the West line of said tract of
land, a distance of 188.11 feet; thence Northerly, continuing along said West
line, along a curve to the right, having an initial tangent bearing of North
3233'00" West, a radius of 750.75 feet and a central angle of
4045'03", an arc distance of 533.96 feet; thence North 0812'03"
East, continuing along said West line, a distance of 100.00 feet; thence
Northerly, continuing along said West line, along a curve to the left, tangent
to the last described course, having a radius of 2518.54 feet, and a central
angle of 1357'19", an arc distance of 613.43 feet; thence Northerly,
continuing along said West line, along a curve to the left, tangent to the last
described course, having a radius of 754.23 feet and a central angle of
4140'40", an arc distance of 548.64 feet to a point on the East line of
North Garfield Avenue, as now established; thence South 0943'28" West,
along said East line, a distance of 222.44 feet; thence Southerly continuing
along said East line, along a curve to the left, tangent to the last described
course, having a radius of 475.00 feet and a central angle of 1737'11",
an arc distance of 73.40 feet; thence South 8459'36" East, along the
North line of said Lot 18, a distance of 90.59 feet, to the Northeast corner
thereof; thence South 1556'41" East, along the East line of Lots 18, 17,
16 and 15, said FARVIEW, a distance of 323.86 feet to the Southeast corner of
Lot 15; thence South 0905'09" West, along the East line of Lots 14, 13,
12, 11 and 10, said FARVIEW, a distance of 415.73 feet to the Southeast corner
of Lot 10; thence North 7457'23" West, along the South line of Lot 10, a
distance of 160.00 feet, to the Southwest corner thereof; thence South
1505'34" West, continuing along the said East line, a distance of 53.22
feet; thence South 0428'54" West, continuing along said East line to the
Northwest corner of Tract 2, Lot Split of Lot 9, Block 15 FARVIEW, a distance
of 232.15 feet; thence South 8531'17" East, along the North line of said
Tract 2, a distance of 189.49 feet, to the Northeast corner thereof; thence
South 0032'04" East, along the East line of Tracts 2 and 3, said Lot
Split of Lot 9, Block 15 Farview and Lots 8, 7 and 6, said FARVIEW, a distance
of 333.25 feet to the Southeast corner of Lot 6; thence South 0033'10"
East, along the East line of Lots 5, 4, 3, 2 and 1, Block 15, said FARVIEW and
the Southerly prolongation thereof, a distance of 356.11 feet (Platted 355.52
feet) to a point on the South line of the Southwest Quarter of the Southeast
Quarter of said Section 12; thence North 8933'40" East, along the South
line of said Quarter Quarter Section, a distance of 114.00 feet to the Point of
Beginning. Containing 7.905 Acres, more or less.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri,
commonly known as the Subdivision Regulations.
2. That the developer submit a macro/micro storm drainage study
to Development Services for approval for the entire development when the first
plat is submitted, and that the developer construct any improvements as
required by Development Services.
3. That the developer improve the eastern one-half of Garfield
Avenue to local street standards as required by Development Services, including
curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section
transitions to meet vertical and horizontal alignment standards, and relocation
of utilities.
4. That the developer obtain the grading consents, and all
grading, temporary construction and drainage/sewer easements from the abutting
property owner prior to submitting any public improvements.
5. That any relocated streetlights be integrated into the
existing street light system as required by Development Services.
6. That the developer submit plans for grading, siltation, and
erosion control to Development Services for approval and permitting prior to
beginning any construction activities.
7. That the developer secure a land disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area exceeds one acre.
8. That the developer extend sanitary sewers to ensure individual
service is provided to all proposed lots and determine adequacy as required by
Development Services.
9. That the developer provide a storm water conveyance system to
serve all proposed lots within the development and determine adequacy as
required by Development Services.
10. That the developer contribute $1,548.03 in lieu of parkland
dedication for 7 units (7 units 3.7 .006 $9,961.61 (year 2005) =
$1,548.03) in satisfaction of Section 66-128 of the Subdivision Regulations.
11. That the developer extend water mains as required by the Water
Services Department.
12. That the developer submit covenants, conditions and
restrictions to the Law Department for approval for the maintenance of private
open space and enter into a covenant agreement for the maintenance of any
stormwater detention area tracts.
13. That the developer submit
a street tree planting plan as part of the final plat, secure the approval of
the City Forester for street trees planted on right-of-way in front of
residential lots (with a copy to be submitted to the City Development
Department staff), and agree to plant in conformance with the plan approved by
the City Forester. The plan shall include size, type, species, and placement
of trees.
14. That
the 3:1 depth to width ratio per Section 66-124 of the Subdivision Regulations
be waived for Lots 5 through 7.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
