ORDINANCE NO. 001265

 

Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 4 acre tract of land generally located at 13901 East U.S. 350 Highway. (10565-P-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 4 acre tract of land generally located at 13901 East U.S. 350 Highway, and more specifically described as follows:

 

All that part of the West 1/2 of the Southwest 1/4 of Section 23, Township 48, Range 32, in Jackson County, Missouri, described as follows: Beginning at the intersection of the east line of said 1/2-1/4 Section with the southerly line of U.S. Highway No. 50; thence northwesterly along said southerly line, 350.0 feet; thence South 56E32' West at right angles to said southerly line of U.S. Highway No. 50, 300.0 feet; thence South 33E28' East, 817.95 feet to a point in the east line of said 1/2-1/4 Section; thence north 561.02 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer extend sanitary sewers as required by the Department of Public Works.

 

5. That the developer install fire hydrants and provide for fire protection as required by the Fire Department.

 

6. That the developer install hard surfaces for all parking areas and automobile storage areas in accordance with Chapter 52, Parking station.

 

7. That the developer remove any contractors equipment and materials and semi-truck tractors from the site prior to approval of the final plan.


8. That the developer remove any signage located within the right of way of East U.S. 350 Highway as required by the Department of Public Works.

 

9. That the developer remove all existing signage prior to approval of a final plan as required by the Department of City Development.

 

10. That the developer obtain a building permit for any building constructed without a permit and for any electrical improvements completed without a permit prior to approval of a final plan.

 

11. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

12. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

13. That the developer show the limits of the floodplain on the final plat as required by the Department of Public Works.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping and signage with elevation drawings, prior to the issuance of any building permits.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 001264, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
