ORDINANCE NO. 070509

Authorizing a $6,165.00 contract Amendment No. 1 with Larkin Group Inc., for additional design services; authorizing the City Manager to expend previously appropriated funds; and assessing the properties benefited.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is hereby authorized, on behalf of the City, to execute a $6,165.00 contract Amendment No. 1 with Larkin Group Inc., for Project No 89003400 for additional design services for the NE 88th and N. Lathrop, sanitary sewer improvements

Section 2. The City Manager is authorized to expend funds up to the amount of $6,165.00 from funds previously appropriated in Account No. 07-3010-B-898882-89003400 for this project.

Section 3. That when the sewer system designed under this agreement is built, the cost of this design contract shall be included in the costs to be specially assessed against the benefited properties as provided in Article VIII of the City Charter and the proceeds from the assessment of that cost shall be returned to the Sewer Special Assessment Fund.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
