ORDINANCE NO. 010181
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0345,
rezoning an area of approximately 2.1 acres generally located on the south side
of Blue Ridge Boulevard, approximately 700 feet east of U.S. Highway 71, from
District C-3a1 (Intermediate Business, Low Buildings) to District PD/C-3a1
(Planned District/Intermediate Business, Low Buildings), and approving a
development plan for the same. (12325-PD-2)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0345, rezoning an area of
approximately 2.1 acres generally located on the south side of Blue Ridge
Boulevard, approximately 700 feet east of U.S. Highway 71, from District C-3a1
(Intermediate Business, Low Buildings) to District PD/C-3a1 (Planned
District/Intermediate Business, Low Buildings), said section to read as
follows:
Section
80-11A0345. That an area legally described as:
TRACT 1: A tract of land being a part of the
Southwest Quarter of the Northwest Quarter of Section 12, Township 47, Range
33, in Kansas City, and a part of the Northwest Quarter of the Southwest
Quarter of said Section 12, in the City of Grandview, all in Jackson County,
Missouri; and all being more particularly described as follows: Beginning at
the northwest corner of Lot 12 of Crossgates, a subdivision in Grandview,
Jackson County, Missouri, said point being the intersection of the south line
of the Northwest Quarter of said Section 12, and a line 1060 feet east of and
parallel with the west line of said Section 12; thence South 00E01'12" West along said parallel line
and the west line of said Crossgates subdivision, a distance of 300.00 feet;
thence North 45E17'26" West, a
distance of 506.64 feet to a point that is the south corner of a tract of land
described in Book 1924 at page 865; thence North 45E03'28" East along the southeast line
of said tract, a distance of 150.00 feet to the east corner of said tract;
thence South 44E56'50" East, a
distance of 227.22 feet to a point on the south line of the Northwest Quarter
of said Section 12; thence South 89E02'10"
East along said south line, a distance of 93.40 feet to the point of
beginning. Contains 68,702 square feet or 1.58 acres, more or less.
TRACT 2: All that part of the Northwest Quarter
of Section 12, Township 47, Range 33, in Kansas City, Jackson County, Missouri,
described as follows: Commencing at the intersection of the southeasterly line
of Blue Ridge Boulevard Extension, as now established, with a line drawn 1060
feet east of and parallel with the west line of said section; thence
southwesterly along said southeasterly line 508.52 feet to the point of
beginning of the tract of land to be herein described; thence departing said
southeasterly line South 44E56'50"
East, a distance of 150.00 feet; thence South 45E03'28" West for a distance of 150.00 feet;
thence North 44E56'50" West for a
distance
of 150.00 feet to said southeasterly line of Blue Ridge Boulevard Extension;
thence along said southeasterly line North 45E03'28"
East, a distance of 150.00 feet to the point of beginning. Contains 22,500
square feet or 0.52 acres, more or less.

hereby rezoned from District C-3a1 (Intermediate Business, Low Buildings) to
District PD/C-3a1 (Planned District/Intermediate Business, Low Buildings), all
as shown outlined on a map marked Section 80-11A0345, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section
B. That a development plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That the developer cause the
area to be platted and processed in accordance with Chapter 66, Code of
Ordinances of the City of Kansas City, Missouri, as amended, commonly known as
the Subdivision Regulations.
2. That the developer submit a
storm drainage study for the entire development to the City Engineers Office
for approval and that the developer make any necessary improvements as required
by the City Engineers Office.
3. That the developer submit plans
for grading and siltation and erosion control to the City Engineers Office for
approval prior to the commencement of any construction activities.
4. That the developer secure a
land disturbance permit from the Department of Public Works prior to beginning
any construction, grading, clearing or grubbing activities, if the disturbed
area exceeds one acre.
5. That the developer provide for
fire protection as required by the Fire Department prior to construction beyond
foundations.
6. That the developer improve the
south half of Blue Ridge Boulevard to primary arterial street standards as
required by the Department of Public Works.
7. That the developer receive a
height variance for the southerly pylon sign from the Board of Zoning
Adjustment prior to approval of a final plan.
8. That the developer submit a
final plan to the City Plan Commission for approval, including detailed
information on landscaping, signage (including elevations) and building
elevations, with infill ornamental trees installed along the east property line
to match the spacing of the other perimeter plantings.
A copy of said development
plan is on file in the office of the City Clerk under Document No. 010181,
which is attached hereto and made a part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices have been given and hearings have
been held as required by the Zoning Ordinance.
