ORDINANCE NO. 100349
Approving the First Amended and
Restated Indiana Corridor Urban Renewal Plan for an area of approximately 59
acres generally bounded by Benton Plaza on the north, Interstate 70 on the
east, 24th Street on the south and College Avenue, Kansas Avenue and
Bellefontaine Avenue on the west, and declaring the area to be a blighted and
insanitary area in need of redevelopment and rehabilitation pursuant to the
Missouri Land Clearance for Redevelopment Authority law. (519-S-1)
WHEREAS, Section
99.430, Revised Statutes of Missouri, provides that a legislative body may
approve a declaration of blight and approve an urban renewal plan for the same
area simultaneously; and
WHEREAS, it is
desirable and in the public interest that the Land Clearance for Redevelopment
Authority of Kansas City, Missouri, submit a First Amended and Restated Indiana
Corridor Urban Renewal Plan for the area generally bounded by Benton Plaza on
the north, Interstate 70 on the east, 24th Street on the south and College
Avenue, Kansas Avenue and Bellefontaine Avenue on the west; and
WHEREAS, said area is
blighted due to the insanitary or unsafe conditions, deterioration of site
improvements, and a combination of such factors so as to constitute an economic
or social liability to the public health, safety, morals or welfare; and
WHEREAS, the Land
Clearance for Redevelopment Authority of Kansas City, Missouri, did on the 16th
day of December, 2009, adopt a resolution recommending that the area be
declared blighted and recommending approval of a First Amended and Restated
Indiana Corridor Urban Renewal Plan for the area generally bounded by Benton
Plaza on the north, Interstate 70 on the east, 24th Street on the south and
College Avenue, Kansas Avenue and Bellefontaine Avenue on the west, said
resolution being set forth and incorporated in the First Amended and Restated
Indiana Corridor Urban Renewal Plan; and
WHEREAS, the City
Plan Commission reviewed and recommended approval of the designation of blight
and approval of the First Amended and Restated Indiana Corridor Urban Renewal
Plan on December 1, 2009, and found said plan to be in conformance with the
Master Plan for the development of the community as a whole, subject to certain
conditions; NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That the
proposed Urban Renewal area identified as the First Amended and Restated
Indiana Corridor Urban Renewal Plan generally bounded by Benton Plaza on the
north, Interstate 70 on the east, 24th Street on the south and College Avenue,
Kansas Avenue and Bellefontaine Avenue on the west, and more specifically
described as:
Beginning at the
point of intersection of the easterly right-of-way of Bellefontaine Avenue and
the southerly right-of-way of Benton Plaza; thence easterly along said
southerly right –of-way of Benton Plaza extended to its point of intersection
with the westerly right-of-way of Interstate 70; thence generally
south-southeasterly along said westerly right-of-way if Interstate -70 to its
point of intersection with the northerly lot line of Lot 15, Block1,
Re-subdivision of Part of Zahl’s Subdivision ; thence southerly along the
easterly lot line of Lot 15, Block 1, Re-subdivision of part of Zahl’s
Subdivision to its point of intersection with the southerly lot line of Lot 15;
thence westerly along said southerly lot line to its point of intersection with
the easterly right-of-way of the public alley; thence southerly along said
easterly right-of-way of the public alley to its point of intersection with
the northerly right-of way of East 24th Street thence westerly along
said northerly right-of-way extended to its point of intersection with the
westerly right-of-way of Indiana Avenue; thence northerly along said westerly
right-of-way of Indiana Avenue to its point of intersection with southerly lot
line of Lot 26 of Stiles Addition,; thence westerly along said southerly lot
line of Lot 26 of Tiles Addition to its point of intersection with the easterly
right-of-way of the public alley thence northerly along said easterly
right-of-way of the public alley to its point of intersection with the
northerly lot line of Lot 34 of Tiles Addition; thence easterly along said
northerly lot line of Lot 34 of Stiles Addition a distance of 92.5 feet; thence
northerly along the westerly parcel line of 2300-2310 Indiana extended to its
point of intersection with the northerly right-of-way of East 3rd
Street; thence westerly along said northerly right-of-way of East 23rd
Street to its point of intersection with the easterly right-of-way of the
public alley, thence northerly along said easterly right-of-way to a point
approximately 74.4 feet south of southerly right-of-way East 20th
Street; thence easterly approximately 55 feet; thence northerly approximately
74.4 feet to the southerly right- of-way of east 20th Street ;
thence westerly along the southerly right-of-way of East 20th Street
to its point of intersection with the extended westerly lot line of Lot 32,
Block 3 Walnut Grove; thence northerly along the westerly lot line of Lots 32
and 14, Block 3, Walnut grove, to its point of intersection with the southerly
right-of-way of East 19th Terrace; thence westerly along said
southerly right-of-way of East 19th terrace extended to its point of
intersection with the westerly right-of-way of Agnes Avenue; thence northerly
along said westerly right-of-way of Agnes Avenue to its point of intersection
with the southerly lot line of Lot 8 of Preston Place 2nd plat;
thence westerly along said southerly lot line of Lot 8 Preston Place 2nd
Plat to its point of intersection with the easterly right-of-way of the public
alley; thence northerly along said easterly right-of-way of the public alley to
its point of intersection with the northerly lot line of Lot 4 of Preston
Place 2nd Plat; thence generally east-northeasterly through Lot 3
of Preston Place 2nd Plat along the southerly right-of-way of the
Kansas City Terminal Railway to a point of intersection of said southerly
right-of-way of Kansas City Terminal Railway the northerly lot line of Lot 3
Preston Place 2nd Plat and the westerly right-of-way of Agnes
Avenue; thence northerly along said westerly right-of-way of Agnes Avenue
extended to its point of intersection with the northerly right-of-way of the
Kansas City Terminal railway; thence generally northeasterly along said
southerly right-of-way of the Kansa City Terminal Railroad to its point of
intersection with the easterly lot line of Lot 10, City Park Addition; thence
northerly along said easterly lot line of Lot 10, City Park Addition extended
to the easterly lot line of Lot 10, Block 1 City Park Addition extended to the
easterly lot line of Lot 10, Block 1 City Park Addition lying northerly of the
Kansas City Terminal Railway to its point of intersection with the southerly
lot line of Lot 16 Block 5 of Arlington; thence westerly along said southerly
lot line of Lot 16 to its point of intersection with the easterly right-of-way
of the public alley; thence northerly along said easterly right-of-way of
public alley to its point of intersection with the southerly right-of-way of
East 17th Street; thence easterly along said southerly right-of-way
to its point of intersection with the easterly right-of-way to its point of
intersection with the easterly right-of-way of Bellefontaine Avenue; thence
northerly along said easterly right-of-way of Bellefontaine Avenue to its point
of intersection with the southerly right-of-way of Benton Place, said point
being the Point of Beginning, all lying situate in the Kansas City, Jackson
County, Missouri.
is a blighted area and in need of
redevelopment and rehabilitation and is appropriate for an Urban Renewal
Project, and that the undertaking by the Land Clearance for Redevelopment
Authority of Kansas City, Missouri, of surveys and plans for an urban renewal
project of a character contemplated by Section 99.430, Revised Statutes of
Missouri, as amended, and the proposed urban renewal area is hereby approved.
Section 2. That the
Council has duly made the findings necessary for compliance with Sections
99.320 and 99.430, Revised Statutes of Missouri, as amended.
Section 3. That the
amendment to the Urban Renewal Plan which is known as the First Amended and
Restated Indiana Corridor Urban Renewal Plan, a copy of which is on file in the
office of the City Clerk with this ordinance and is made a part hereof, is
hereby approved.
Section 4. That the First
Amended and Restated Indiana Corridor Urban Renewal Plan is hereby found to be
feasible and in conformance with the Master Plan for the development of the
community as a whole.
