ORDINANCE NO. 200091

 

Authorizing the City Manager to enter into a license and maintenance agreement with Platte County R-3 School District to maintain a pedestrian box culvert in the public right-of-way under a section of Tiffany Springs Road.

 

WHEREAS, under a plan for redevelopment known as the Platte Purchase Development Plan, certain road and infrastructure improvements are to be constructed in an area generally located on, to and around N. Platte Purchase Road, north of 152 Highway in Platte County, Missouri (“Public Improvement Project”); and

 

WHEREAS, the City is undergoing development of a 12 field multi-sports complex adjacent to the Public Improvement Project which is connected and a part of the redevelopment plan; and

 

WHEREAS, as part of the Public Improvement Project, a pedestrian box culvert has been proposed for construction under a section of Tiffany Springs Road; and

 

WHEREAS, the City is looking to adopt a Vision Zero policy to eliminate auto related deaths; and

 

WHEREAS, a dedicated pedestrian underpass is proven to be the safest way for pedestrians to cross a multi-lane arterial street, as the chance for vehicles hitting pedestrians is zero; and

 

WHEREAS, a pedestrian underpass provides fewer future maintenance obligations as a pedestrian-only HAWK signal; and

 

WHEREAS, traffic flow on Tiffany Springs Road would be hindered by forcing Platte County High School students and parents to cross at a signalized intersection in large, clustered numbers during sporting and assembly events by creating long pedestrian crossing phases; and

 

WHEREAS, the City will benefit from having the pedestrian underpass by leveraging parking constructed on the Platte County school site; and

 

WHEREAS, Platte County R-3 School District will benefit from not having to construct its own district sports stadium, which will mean less impervious surface and water quality degradation and require that less land be dedicated to surface parking; and

 

WHEREAS, Platte County R-3 School District agrees to provide for the operational maintenance of the pedestrian underpass; and

 


WHEREAS, the City wishes to enter into an agreement with and grant a license to Platte County R-3 School District to maintain the pedestrian underpass; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to enter into a license and maintenance agreement with Platte County R-3 School District to maintain a pedestrian box culvert underpass in a public right-of-way under a section of Tiffany Springs Road. A copy of the agreement and license is approved in substantial form and is on file in the Office of the City Manager.
