RESOLUTION NO. 970096

Approving a second amendment to the Oak Park North Area Plan being that part of Kansas City bounded by Troost Avenue, Stadium Drive and Leeds Trafficway, 31st Street and 39th Street.

WHEREAS, the City has adopted the Oak Park North Area Plan by Resolution No. 47190 for that part of Kansas City generally bounded by Troost Avenue, Stadium Drive and Leeds Trafficway, 31st Street and 39th Street; and

WHEREAS, the City has adopted an amendment to the Oak Park North Area Plan by passage of Resolution No. 63760, as amended, passed April 13, 1989; and

WHEREAS, the City Development Department has had cause to review the proposed land use map for that area generally located at the southeast corner of Linwood Boulevard and Wabash Avenue; and

WHEREAS, said amendment would allow a change in the land use plan from "high density residential 29 units and over per acre" to "retail commercial"; and

WHEREAS, legal notice of the proposed amendment to the Oak Park North Area Plan was published on December 16, 1996; and

WHEREAS, on January 7, 1997, the City Plan Commission did recommend approval of the proposed amendment; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That the Oak Park North Area Plan is hereby amended by repealing the land use plan therefore and adopting in lieu thereof a new land use plan, a copy of which is attached hereto and incorporated herein by reference, to provide for retail commercial for that area within the plan located at the southeast corner of Linwood Boulevard and Wabash Avenue.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
