SUBSTITUTE FOR ORDINANCE NO. 160669, AS AMENDED
Approving the petition to establish the InterContinental
Community Improvement District; establishing the InterContinental Community
Improvement District generally located at the southwest corner of the
intersection of Ward Parkway and Wornall Road in Jackson County, Kansas City,
Missouri; determining the InterContinental Community Improvement District to be
a blighted area; determining that certain actions are reasonably anticipated to
remediate blighting conditions and will serve a public purpose; authorizing the
City Manager to execute a cooperative agreement with the petitioner in
connection with the InterContinental Community Improvement District; requiring
the annual submission of certain records; directing the City Clerk to report
the creation of the InterContinental Community Improvement District to the
Missouri Department of Economic Development; and providing an effective date.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the petition to establish the
InterContinental Community Improvement District (the “District”) as a political
subdivision in accordance with Sections 67.1401 - 67.1571, RSMo, otherwise
known as the Community Improvement District Act (the “Act”), is hereby approved
in its entirety.
Section 2. That the District is hereby
established for the purposes set forth in the Petition, that the District shall
have all the powers and authority authorized by the Petition, the Act, and by
law, and shall continue to exist until the earlier of the satisfaction of the
CID Debt or for a period of twenty (20) years, provided however that the
District may be automatically continued for two successive ten year terms,
without having to submit a new petition, subject to the condition precedent
that the City Council shall not have adopted a resolution disallowing such
continuation prior to the date upon which any successive term would have
commenced.
Section 3. That the District is hereby
determined to be a blighted area by reason of the predominance of insanitary or
unsafe conditions and deterioration of site improvements, all of which
individually and collectively constitute an economic liability, social
liability and menace to the public health, safety, morals and welfare in its
present condition and use.
Section 4. That it is hereby determined that a
contract with the owner of the land and improvements lying within the
District’s boundaries for the purposes of making the improvements identified in
Exhibit D of the Petition and the expenditure or loaning of the District’s revenues
to fund a contract for the improvements so listed, are reasonably anticipated
to remediate the blighting conditions and will serve a public purpose.
Section 5. That the City Manager is hereby
authorized to execute, on behalf of the City, a cooperative agreement with TPG
KC MO I, LLC, the petitioner for the InterContinental Community Improvement
District, whereby the petitioner has voluntarily elected to make commitments
with respect to the utilization of a Kanas City, Missouri workforce and providing
funding to assist senior citizens in making home repairs needed to eliminate
housing code violations. The agreement is approved in substantial form as
attached hereto.
Section 6. That the District shall annually submit its
proposed budget, report and copies of written resolutions passed by the
District’s board to the City pursuant to Section 67.1471, RSMo.
Section 7. That upon the effective date of this ordinance,
the City Clerk is hereby directed to report the creation of the District to the
Missouri Department of Economic Development pursuant to Section 67.1421.6,
RSMo, by sending a copy of this ordinance to said agency.
Section 8. That the blight determination herein shall not
be utilized as a basis for granting any tax abatement or tax redirection under
any other provision of law.
Section 9. That this ordinance shall become effective at
such time as TPG KC MO I, LLC and the City Manager shall execute the
cooperative agreement authorized herein, or ten days after the date of passage
by the City Council, whichever shall last occur.
