Approving the preliminary plat of
27th Street Townhomes on a .29 acre tract of land located at the northwest
corner of 27th Street and Campbell Street. (SD 1512-B)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of 27th Street Townhomes on a .29 acre tract of land
located at the northwest corner of 27th Street and Campbell Street,
and more specifically described as follows:
All
of Lot 12 and the south 14.00 feet of Lot 13, Block 5, Continuation of J.L.
Porter's 2nd Subdivision, a final plat to the City of Kansas City, Jackson
County, Missouri, according to the recorded plat thereof, being more
particularly described as follows: Beginning at the southeast corner of said
Lot 12; thence North 87 degrees 09 minutes 25 seconds West along the south line
of said Lot 12, also being along the north right-of-way line of East 27th
Street, as now established, a distance of 159.97 feet (160.00' = plat) to the
southwest corner of said Lot 12; thence North 02 degrees 17 minutes 37 seconds
East along the west line of said Lots 12 and 13, a distance of 78.08 feet
(78.00' = deed); South 87 degrees 06 minutes 21 seconds East along a line 14.00
feet north of and parallel with the south line of said Lot 13, a distance of
160.14 feet (160.00' = plat) to the east line of said Lot 13; thence South 02
degrees 24 minutes 43 seconds West on the east line of said Lots 13 and 12,
also being on the west right-of-way line of Campbell Street, as now
established, a distance of 77.94 feet (78.00' = deed) to the point of
beginning. Contains 12,485 square feet or 0.29 acres, more or less.
is hereby approved, subject to
the following conditions:
1.
The developer shall cause the area to be platted
and processed in accordance with Chapter 88, Code of Ordinances of the City of
Kansas City, Missouri.
2.
The developer shall submit a Storm Drainage
analysis from a Missouri licensed civil engineer to the Land Development
Division evaluating proposed improvements and impact to drainage conditions.
Since this project is within a "Combined Sewer Overflow" (CSO)
district, the project shall be designed to retain rainfall of 1.5 inch depth
over the entire site to simulate natural runoff conditions and reduce small storm
discharge to the combined sewer system and manage the 10-year storm and
100-year storm per currently adopted APWA standards. The analysis shall be
submitted,
and the developer shall secure permits to construct any
improvements required by the Land Development Division prior to recording the
plat.
3.
The developer shall verify vertical and
horizontal sight distance for the drive connection to public right-of-way and
make improvements to ensure local jurisdiction and/or minimum AASHTO adequate
sight distance standards are met.
4.
The developer shall submit a letter to the Land
Development Division from a licensed civil engineer, licensed architect, or licensed
landscape architect, who is registered in the State of Missouri, to identify sidewalks,
curbs, and gutters in disrepair as defined by Public Works Department's
"OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised
4/8/09" and based on compliance with Chapters 56 and 64, Code of
Ordinances, for the sidewalks, curbs, and gutters where said letter shall
identify the quantity and location of sidewalks, curbs, and gutters that need
to be constructed, repaired, or reconstructed to remedy deficiencies and/or to
remove existing approaches no longer needed by this project. The developer
shall secure permits to repair or reconstruct the identified sidewalks, curbs,
and gutters as necessary along all development street frontages as required by
the Land Development Division and prior to issuance of any certificate of
occupancy permits including temporary certificate of occupancy permits.
5.
The developer must obtain the executed and
recorded City approved grading, temporary construction, drainage/sewer, or any
other necessary easements from the abutting property owner(s) that may be
required prior to submitting any public improvements crossing properties not
controlled by the developer and include said document(s) within the public
improvement applications submitted for permitting.
6.
The developer shall submit an analysis to verify
adequate capacity of the existing sewer system as required by the Land
Development Division prior to issuance of a building permit to connect the private
system to the public sewer main and depending on adequacy of the receiving
system, make other improvements that may be required.
7.
The
developer shall pay $1,821.61 in lieu of parkland dedication.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. The
following waivers to the subdivision design standards are approved pursuant to
88-405-25:
1.
Lot 1
a.
A waiver to the front yard setback in the amount of 4.5’.
2.
Lot 2
b.
A waiver to the front yard setback in the amount of 4.5’.
c.
A waiver to the minimum lot area in the amount of 809 square feet.
3.
Lot 3
d.
A waiver to the front yard setback in the amount of 4.5’.
e.
A waiver to the minimum lot area in the amount of 804 square feet.
4.
Lot 4
f.
A waiver to the front yard setback in the amount of 4.5’.
g.
A waiver to the minimum lot area in the amount of 809 square feet.
5.
Lot 5
h.
A waiver to the front yard setback in the amount of 4.5’.
Section C. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
