ORDINANCE NO. 170512

 

Authorizing the Director of Water Services to execute a Memorandum of Agreement with the U.S. Army Corps of Engineers for the construction of a waterline relocation associated with the Missouri Interceptor of the Turkey Creek Flood Control Project; authorizing the Director of Water Services to expend the sum of $120,000.00 for the construction; and authorizing the Director of Finance to return unexpended appropriations to the appropriate account.

 

WHEREAS, by Ordinance No. 63673, the City authorized a feasibility study with the U.S. Army Corps of Engineers to formulate a flood damage reduction project for Turkey Creek; and

 

WHEREAS, by Resolution Nos. 950301 and 990018, the City expressed its continued support of the Turkey Creek Flood Control Project and requested the U.S. Army Corps of Engineers to complete the project as rapidly as possible; and

 

WHEREAS, by Ordinance Nos. 990396 and 991508, the City authorized the agreement and expenditures for the U.S. Army Corps of Engineers to design the Turkey Creek Flood Damage Reduction Project; and

 

WHEREAS, by Ordinance No. 041333, the City authorized the expenditure of $3,900,000.00 for Turkey Creek tunnel rehabilitation as part of the Turkey Creek flood damage reduction project in cooperation with the U.S. Army Corps of Engineers and the Unified Government of Wyandotte County and Kansas City, Kansas; and

 

WHEREAS, by Ordinance No. 060666, the City authorized the Turkey Creek Project Cooperation Agreement (PCA) with the U.S. Army Corps of Engineers and the Unified Government of Wyandotte County and Kansas City, Kansas to enter into a Cooperative Agreement with the Unified Government to expend $2,973,776.00 in funds for the City’s required contribution to the PCA and to expend $1,100,000.00 for the construction of the Turkey Creek tunnel rehabilitation; and

 

WHEREAS, the City now requests the U.S. Army Corps of Engineers to construct the waterline relocation to accommodate the construction of the Missouri Interceptor of the Turkey Creek Flood Control Project at a cost of $120,000.00; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute a Memorandum of Agreement (MOA)with the U.S. Army Corps of Engineers relating to design of the Turkey Creek Flood Control Project, Project No. 89003209. A copy of the agreement is on file with the Director of Water Services.

Section 2. That the Director of Water Services is hereby authorized to expend up to the sum of $120,000.00 to the U.S. Army Corps of Engineers from funds previously appropriated to Account No. 18-3090-808054-611060, for this purpose.

 

Section 3. That upon completion of the final costs of this agreement, the Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the Fund Balance from which it is derived.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
