ORDINANCE NO. 951255, AS AMENDED
Approving a Community Unit Project on a tract of land of
approximately 736 acres generally bounded by N.E. 100th Street, N. Woodland
Avenue, Missouri Highway 291 and N.E. Staley Road. (11660-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on a tract
of land of approximately 736 acres generally bounded by N.E. 100th Street, N.
Woodland Avenue, Missouri Highway 291 and N.E. Staley Road, and more
specifically described as follows:
All that part of the West One-Half of the Southeast
Quarter of Section 24, all that part of the Northeast Quarter and the
Southeast Quarter of Section 25, the Northeast Quarter of Section 36, all
in Township 52, Range 33, all that part of the Southeast and Southwest
Quarter of Section 30, the West One-Half of the Northeast Quarter of
Section 31, the Northwest Quarter of Section 31, all in Township 52, Range 32,
in Kansas City, Clay County, Missouri, being bounded and described as
follows: Beginning at the southeast corner of the Northeast Quarter of
Section 36, Township 52, Range 33; thence North 89 15'00" West, along
the south line of said Northeast Quarter, 2613.27 feet to the southwest
corner of said Northeast Quarter; thence North 0 27'00" East, along
the west line of said Northeast Quarter, 2636.27 feet to the southwest
corner of the southeast corner of said Section 25; thence North 0 43'50"

of beginning. Except that part granted to Missouri Public Service Company
as contained in the Report of Commissioners recorded in Book 1102 at page
436, being described as follows: Beginning at a point on the west line of
the Northeast Quarter of said Section 36, said point being 64.00 feet
south of the northwest corner of said Northeast Quarter, thence South 89
23'36" East, 200.00 feet; thence North 0 27'00" East, 64.00 feet
to a point on the north line of said Northeast Quarter; thence South 89
23'36" East, along said north line, 400.00 feet; thence South 0
27'00" West, 214.00 feet; thence North 89 23'36" West, 400.00
feet; thence North 0 27'00" East, 130.00 feet; thence North 89
23'36" West, 200.00 feet to a point on the west line of said
Northeast Quarter; thence North 0 27'00" East, along said west line, 20.00
feet to the point of beginning. Containing 735.66 acres, more or less.
Except that part on the west in N. Woodland Avenue, that part on the south
in 100th Street, and that part lying in Staley Road, as now established,
being used for road right-of-way.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval at the time the first final plat is submitted and
that the developer make any necessary
improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer dedicate right of way for N.
Woodland as required by the Department of Public Works so as to
provide 75 feet of right of way as measured
from the centerline of N. Woodland, including
dedication of right of way along the
Mo-Pub substation frontage.
5. That the developer improve one-half of N.
Woodland to parkway street standards, including improvement along the
Mo-Pub substation frontage.
6. That the developer improve one-half of N.E.
100th Street to collector street standards and that the developer
dedicate additional right of way for N.E. 100th Street as
required by the Department of Public Works.
7. That the developer dedicate right of way for
Shoal Creek Parkway as required by the Department of Public Works so
as to provide 100 feet of right of way from the
centerline of each side of Shoal Creek Parkway
that abuts the development plan.
8. That the developer grade full width right of
way and construct two lanes to parkway standards for Shoal Creek Parkway.
9. That the developer dedicate right of way for N.
Indiana as required by the Department of Public Works so as to
provide 100 feet of right of way for N. Indiana.
10. That the developer grade the full width of the
right of way and construct two lanes to primary arterial street
standards for N. Indiana.
11. That the developer dedicate right of way for
Staley Road as required by the Department of Public Works so as to
provide 30 feet of right of way as measured
from the centerline of Staley Road and that the
developer improve one-half of Staley
Road to collector street standards.
12. That the developer submit a street name sign
plan for approval and receive approval of the Street Naming Committee
for all street names.
13. That the developer construct temporary
cul-de-sacs as required by the City Engineer's Office.
14. That the developer submit a traffic study to
the City Engineer's Office for approval and that the developer make
improvements as required by the approved traffic study.
15. That the developer extend water mains as
required by the Water Services Department.
16. That the developer extend sanitary sewers as
required by the Water Services Department.
17. That the developer provide fire protection as
required by the Fire Department.
18. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
19. That a variance for all lots exceeding the 3:1
depth to width ratio established by the Subdivision Regulations is
hereby granted.
20. That the developer construct all structures to
comply with the height restrictions of the KCI Airport Height Zoning
Map.
21. That the developer pay money in lieu of
parkland dedication or deliver a deed acceptable to the Board of
Parks and Recreation Commissioners for a 15 acre site
west of N. Woodland, near Shoal Creek Parkway
to be used for park purposes.
22. That the developer submit a final plan to the
City Plan Commission for approval for each stage of development. The
final plan shall include: site plan; dimension plan;
grading plan; landscape plan; and signage plan.
23. That the developer install and maintain
landscaping and buffering of an area along N. Woodland Avenue 200
feet in depth, beginning at Missouri Highway 291 and
extending south 907 feet, at the same time that
the developer begins grading and
construction of the golf course as shown on the
preliminary plan attached hereto.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 951255, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
