COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951249

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2595, rezoning an area of approximately 8 acres generally located at the southeast corner of Blue Ridge Boulevard and Bannister Road from Districts C-2-p (Local Retail Business- Limited District) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), and approving a preliminary plan for the same. (8831-CP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2595, rezoning an area of approximately 8 acres generally located at the southeast corner of Blue Ridge Boulevard and Bannister Road from Districts C-2-p (Local Retail Business - Limited District) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), said section to read as follows:

 

Section 65.010A2595. That an area legally described as:

 

Tract 1. BANNISTER RIDGE SHOPPING CENTER, a subdivision in Kansas City, Jackson County, Missouri, and containing 7.345 acres more or less. All that part of Lot 1, BANNISTER ACRES, a subdivision in Kansas City, Jackson County, Missouri, lying north and west of the following described line: Beginning at a point on the north line of said Lot 1, (formerly the south line of Bannister Road), which is 464 feet west of the northeast corner of said lot; thence south along a line which makes southwest angle of 91 35' with the north line of said lot, 150 feet; thence west on a line which makes a northwest angle of 88 25' with the last described course, 150 feet to the west line of said lot, being also the east line of Blue Ridge Boulevard Extension, except that part now in Bannister Road. Containing 20.680 square feet or 0.47 acres, more or less.

 

is hereby rezoned from Districts C-2-p (Local Retail Business - Limited District) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), all as shown outlined on a map marked Section 65.010A2595, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer construct sidewalks on the east side of Blue Ridge Boulevard and the south side of Bannister Road.

 

2. That the developer extend water mains as required by the Water Services Department.

 

3. That the developer provide for fire protection as required by the Fire Department.

 

4. That the developer extend sanitary sewers as required by the Water Services Department.

 

5. That the developer dedicate 10 additional feet of right of way on the south side of Bannister Road as required by the Department of Public Works so as to match the

existing right of way line on the south side of Bannister Road.

 

6. That the developer contribute to the I-435/I-470 Corridor Improvement Fund for off-site transportations based on the rate of $8.00 per gross square foot of fast food with drive up area.

 

7. That the developer submit a final plan to the City Plan Commission for approval, including a landscaping plan.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 951249, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had. _____________________________________________

 

I hereby certify that as required by Chapter 80, Code of Ordinances, the foregoing ordinance was duly advertised and public hearings were held.
