ORDINANCE NO. 140936

 

Declaring it necessary to change and re-establish the grades and the relocation, opening, establishing and dedication of Right of Way on North Platte Purchase Drive from NW 82nd Street to NW 76th Street; and directing the City Clerk to publish notice and to record this ordinance.

 

WHEREAS, the Council finds that for the public good it is necessary that the grades on North Platte Purchase Drive from NW 82nd Street to NW 76th Street all in Kansas City, Platte and Clay Counties, Missouri, be established; and

 

WHEREAS, the Council further finds that for the public good it is necessary to relocate, open, establish and dedicate Street Right of Way on North Platte Purchase Drive from NW 82nd Street to NW 76th Street all in Kansas City, Platte and Clay Counties, Missouri, be established; and

 

WHEREAS, the Council further finds the Director of Public Works, as evidenced by her issuing a Declaration of Necessity, No. 5520, adopted and entered on February 11, 2014, has caused the plans and specifications for Project Number 89008219 – NW 76th Street to NW 82nd Street, to be prepared; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That finding it necessary to change and re-establish grades on North Platte Purchase Drive from NW 82nd Street to NW 76th Street all in Kansas City, Platte and Clay Counties, Missouri, the Council hereby directs that the City Clerk cause a notice of said grade changes to be published in the newspaper doing the city printing, on each day of issue of said newspaper for a period of ten (10) days upon the effective date of this ordinance, and providing a period of thirty (30) days for remonstrance starting the same day as the first day of publication of this ordinance.

 

Section 2. That said grade changes shall be of the nature described and specified in, and shall be done in accordance with the plans and specifications prepared and certified by the City Engineer under the supervision of the Director of Public Works and identified as Project Number 89008219 – North Platte Purchase Drive from NW 82nd Street to NW 76th Street, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

 

Section 3. That the width of the Right of Way of North Platte Purchase Drive from NW 82nd Street to NW 76th Street all in Kansas City, Platte and Clay Counties, Missouri as shown on the plans described in Section 2 of this ordinance, are hereby relocated, opened, established and dedicated as shown on said plans.

 

Section 4. That the Council finds and declares it necessary to establish said grades on North Platte Purchase Drive from NW 82nd Street to NW 76th Street all in Kansas City, Platte and Clay Counties, Missouri; with the following described centerline of North Platte Purchase, as follows, to wit:

 

A centerline over part of Fractional Sections 10 and 15, Township 51 North, Range 33 West of the 5th Principal Meridian in Kansas City, Platte and Clay County, Missouri, the centerline of which is described as follows:

 

Commencing at the Northwest corner of the Fractional Southwest Quarter of said Section 15; thence South 00 degrees 29 minutes 16 seconds West, along the West line of said Fractional Southwest Quarter, 397.16 feet to the Point of Beginning of the centerline to be herein described; thence North 00 degrees 29 minutes 16 seconds East, along said West line, 397.16 feet; thence North 00 degrees 19 minutes 54 seconds East, 101.15 feet; thence Northerly, along a curve to the right, being tangent to the last described course with a radius of 1,000.00 feet, a central angle of 02 degrees 17 minutes 21 seconds and an arc distance of 39.95 feet; thence North 02 degrees 37 minutes 15 seconds East, 410.68 feet; thence Northerly, along a curve to the left, being tangent to the last described course with a radius of 1,000.00 feet, a central angle of 02 degrees 17 minutes 21 seconds and an arc distance of 39.95 feet; thence North 00 degrees 19 minutes 54 seconds East, 407.81 feet; thence Northerly, along a curve to the right, being tangent to the last described course with a radius of 1,000.00 feet, a central angle of 02 degrees 35 minutes 59 seconds and an arc distance of 45.37 feet; thence North 02 degrees 55 minutes 53 seconds East, 219.20 feet; thence Northerly, along a curve to the left, being tangent to the last described course with a radius of 1,000.00 feet, a central angle of 02 degrees 35 minutes 59 seconds and an arc distance of 45.37 feet; thence North 00 degrees 19 minutes 54 seconds East, 1,363.55 feet; thence North 00 degrees 09 minutes 43 seconds East, 990.50 feet; thence Northerly, along a curve to the left being tangent to the last described course with a radius of 1,146.00 feet, a central angle of 15 degrees 22 minutes 51 seconds and an arc distance of 307.64 feet; thence North 15 degrees 13 minutes 09 seconds West, 343.73 feet; thence Northerly, along a curve to the right, being tangent to the last described course with a radius of 670.00 feet, a central angle of 05 degrees 22 minutes 53 seconds and an arc distance of 62.93 feet to the Point of Termination of said centerline.

 

Section 5. That the changing and re-establishing of grades North Platte Purchase Drive from NW 82nd Street to NW 76th Street is hereby authorized to commence when this ordinance becomes effective, and shall be built in accordance with the plans and specifications as described in Section 2 of this ordinance; locating and defining the grade points of said streets on the proposed project centerline stationing of each respective right-of-way, as found on said plans, said grade points being connected by straight grades (tangents) or vertical curves between such grade points, the elevations of which are herein given below in feet (NAVD88 directrix), along with other pertinent alignment data, to-wit:

Section 7. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Platte and Clay Counties, Missouri.
