Approving a Special Use Permit in accordance with Section
39.041(II)(G) of the Zoning Ordinance of Kansas City, Missouri, in District
R-1a for an electric substation, a 400 foot microwave tower and a communications
equipment building on a 14.7 acre tract of land generally located at 6330 E.
63rd Street Trafficway.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Special Use Permit in accordance
with Section 39.041(II)(G) of the Zoning Ordinance of Kansas City, Missouri, in
District R-1a for an electric substation, a 400 foot microwave tower and a
communications equipment building on a 14.7 acre tract of land generally
located at 6330 E. 63rd Street Trafficway, and more specifically described as
follows:
TRACT 1: All that part of the Southeast 1/4 of
the Northwest 1/4 of Section 1, Township 48, Range 33, in Kansas
City, Jackson County, Missouri, lying north and east of 63rd Street
Trafficway, as now established, except that part thereof lying within the
north 1.98 acres of said 1/4 1/4 section.
TRACT 2: All that part of the south 7.72 acres of
the Northeast 1/4 of the Northwest 1/4, and the north 1.98 acres of
the Southeast 1/4 of the Northwest 1/4 of Section 1, Township 48, Range
33, lying northeasterly of the northeasterly line of 63rd Street
Trafficway, as now established, all in Kansas City, Jackson County,
Missouri.
TRACT 3: That part of the Northeast 1/4 of the
Northwest 1/4 of Section 1, Township 48, Range 33, described as
follows: Beginning 254.76 feet north of the southeast corner of said 1/4
1/4 Section; thence west 1320 feet; thence north 264 feet; thence east
1320 feet; thence south 264 feet to the point of beginning, except
that part thereof in 63rd Street Trafficway, Kansas City, Jackson
County, Missouri. Contains 14.7 acres more or less.
is hereby approved, subject to the following condition:
That the developer provide for fire protection as
required by the Fire Department.
A copy of the plan for the Special Use Permit is on file
in the office of the City Clerk under Document No. 930278, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Special Use Permit hereinabove, all
public notices and hearings required by the Zoning Ordinance have been given
and had.
