ORDINANCE NO. 990549

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0209, rezoning an area of approximately 10.3 acres generally located at the southwest corner of Donovan Avenue and N.W. Prairie View Road from Districts GP-1 (General Industry) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), and approving a development plan for the same. (5935-GP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0209, rezoning an area of approximately 10.3 acres generally located at the southwest corner of Donovan Avenue and N.W. Prairie View Road from Districts GP-1 (General Industry) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), said section to read as follows:

 

Section 80-11A0209. That an area legally described as:

 

TRACT 1: Lot 1, Parkway Self Storage, a subdivision of land in the City of Kansas City, Platte County, Missouri. (Containing 4.93 acres, more or less.)

 

TRACT 2: All of Lot 2, Hillside Heights, a subdivision of land, and all that part of the Southeast Quarter of Section 1, Township 51 North, Range 34 West, in the City of Kansas City, Platte County, Missouri, described as follows: Commencing at the southeast corner of said Southeast Quarter; thence North 0021'13" East, along the east line of said Southeast Quarter, 894.02 feet; thence South 8958'46" West, being parallel with and 894.00 feet north of the south line of said Southeast Quarter and being the north line of an unnamed street per said Hillside Heights, 834.52 feet to the westerly right of way line of U.S. Interstate Highway Route No. I-29 and the southeast corner of Lot 1, Parkway Self Storage, a subdivision of land in said city; thence South 8958'46" West, along the south lot line of said Lot 1, a distance of 128.32 feet to the southwest corner of said Lot 1 and the pont of beginning; thence South 8958'46" West, along an extension of said south lot line, 182.02 feet to the northwest corner of said unnamed street; thence South 0019'29" West, along an extension of the west lot line of Lot 19, said Hillside Heights, 300.00 feet to the southwest corner of said Lot 19; thence South 8958'42" West, along the north lot line of Tract A, Vintage at Pheasant Run - First Plat, a subdivision of land in said city, 210.04 feet to the northwest corner of said Tract A; thence North 0019'38" East, along the east line of Lot 1, said Vintage at Pheasant Run - First Plat, 592.38 feet to the northeast corner of said Lot 1 and the south lot line of Lot 1, The Lakes, Executive Hills North, a subdivision of land in said city; thence North 8957'34" East, along said south lot line, 392.30 feet to the west lot line of said Lot 1, Parkway Self Storage; thence South 0019'08" West, along said west lot line, 291.94 feet to the point of beginning. (Containing 4.08 acres, more or less.)

 


TRACT 3: All that part of an unnamed street and Lots 19 through 22, Hillside Heights, a subdivision of land in the City of Kansas City, Platte County, Missouri, described as follows: Commencing at the southeast corner of the Southeast Quarter of Section 1, Township 51 North, Range 34 West, in said city; thence North 0021'13" East, along the east line of said Southeast Quarter, 894.02 feet; thence South 8958'46" West, being parallel with and 894.00 feet north of the south line of said Southeast Quarter and being the north line of said unnamed street, 834.52 feet to the westerly right of way line of U.S. Interstate Highway Route No. I-29 and the southeast corner of Lot 1, Parkway Self Storage, a subdivision of land in said city and the point of beginning; thence South 4324'21" West, along said westerly right of way line, 413.38 feet to the northeast corner of Tract A, Vintage at Pheasant Run - First Plat, a subdivision of land in said city; thence South 8958'42" West, along the north line of said Tract A, 27.49 feet to the southwest corner of said Lot 19; thence North 0019'29" East, along the west lot line of said Lot 19, a distance of 300.00 feet to the northwest corner of said unnamed street; thence North 8958'46" East, along the north line of said unnamed street and an extension of the south lot line of said Lot 1, a distance of 310.34 feet to the point of beginning. (Containing 1.16 acres, more or less.)

 

is hereby rezoned from Districts GP-1 (General Industry) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), all as shown outlined on a map marked Section 80-11A0209, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer secure the approval of the Missouri Department of Transportation prior to working in any State right of way.

 

7. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, screening, signage (including elevations), grading and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 990549, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
